Alex is 19. At a party, Alex drinks one beer, waits an hour, feels fine and then drives home. A breath test would still find some alcohol. Which rule applies to Alex?
Correct answer: Alex's limit is zero: under 21, it is a crime to drive with any alcohol in the body.
Why
In Minnesota, you must be 21 or older to buy or drink alcohol. A driver under 21 who drives with any alcohol in the body can lose the license for 30 days for a first violation and for 180 days for a second one. If the driver is impaired or at 0.08 or more, the stricter DWI penalties apply instead. The body removes about one drink per hour, but many factors change this, so one hour of waiting does not make it legal for a young driver to drive.
