An officer arrests Driver B for DWI and asks her to take a breath test. She refuses. Under Missouri's implied-consent law, what happens to her driver license?
Correct answer: It is revoked for one year, even for a first refusal
Why
Implied consent means that by driving on Missouri's public roads, you have already agreed to a chemical test of your breath, blood, saliva, or urine if you are arrested for driving while intoxicated. The officer takes your license and gives you a 15-day temporary permit. To get the license back, you must complete a substance-abuse traffic offender program (SATOP) and meet the other reinstatement requirements.
