Safe & Responsible DrivingStandalone practice
A police officer who suspects Driver A of DUI asks Driver A to take a breath test. Driver A refuses. What happens to Driver A's license?
Correct answer: The officer takes it, and a first refusal brings a 6-month suspension
Why
By driving on Montana roads that are open to the public, you are treated as having agreed to be tested for alcohol or drugs when an officer has lawful grounds. The officer must tell you that you may refuse but that refusal will bring a suspension; a second refusal within 5 years brings a 1-year suspension with no restricted license. The officer may also ask a judge for a warrant to take a blood sample.
