Safe & Responsible DrivingStandalone practice
An officer arrests a 30-year-old driver for DWI. The driver has no earlier alcohol or drug arrests or suspensions on record. When the officer asks for a breath specimen, the driver refuses. What happens to the driver's license?
Correct answer: It is suspended for 180 days, whether or not the driver is later prosecuted for DWI.
Why
This rule is called implied consent: by driving on Texas roads, you agree in advance to give a breath or blood specimen if you are arrested for DWI. If you refuse, the officer can ask a judge for a warrant to take a specimen, and the refusal can be used as evidence in court. The suspension is two years if your record shows an alcohol or drug contact in the 10 years before the arrest.
