After a dinner party, you take home a bottle of wine that was opened and then corked again. You drive on a public road in a car that has a trunk. Where may you lawfully carry the bottle?
An empty blue sedan cutaway shows the rear trunk, rear seat, front seats and cup holder. No bottle or highlighted compartment is present. The card says the wine bottle was opened and corked again.
Correct answer: In the trunk of the car, away from the seating area
Why
Texas law bans an open container of alcohol in the passenger area of a vehicle on a public highway, whether the vehicle moves, stops or is parked. A bottle that has been opened counts as open even if you put the cork back in. The trunk is not part of the passenger area, and in a vehicle with no trunk the area behind the last upright seat is not part of it either.
