Safe & Responsible DrivingStandalone practice
An officer has reasonable grounds to believe that a driver is impaired and asks for a breath test. The driver refuses. Under Vermont's implied consent law, what happens to the driver's license?
Correct answer: It is suspended for at least six months, even without a test result.
Why
Every driver on a Vermont highway is deemed to have agreed to an evidentiary test for alcohol or other drugs when an officer has reasonable grounds to ask. A refusal leads to a six-month civil suspension, while a first test result at or above the legal limit leads to 90 days. The refusal can also be used as evidence in court, and in some cases, for example when a driver hinders a blood draw that a warrant allows, it can be charged as a crime.
