You leave a restaurant with a bottle of wine that you opened and partly drank there. You will drive your sedan home. Where should you carry the bottle?
An empty cutaway of blue sedan A shows seats, floor, an open empty glove compartment and the separate rear trunk. No bottle or placement mark appears anywhere.
Correct answer: In the trunk, which is not part of the passenger area
Why
Virginia law forbids drinking alcohol while driving. If an open container with some alcohol removed is in the passenger area and the driver shows signs of drinking, the law presumes that the driver drank while driving. A bottle that is still sealed by the maker is not an open container. In vans, wagons and SUVs, the area behind the last upright seat is also outside the passenger area.
