When may a driver pass another vehicle on the right?
A blue car follows a silver car on a two-way road. A paved shoulder is to their right. There is no turn indication, waiting claim or passing route in the question.
Correct answer: In a permitted case, such as a car turning left, when safe.
Why
A safe right-side pass is allowed when the vehicle ahead is making or about to make a left turn, on an officially marked roadway with multiple lanes in the same direction, or on a sufficiently wide one-way roadway. When passing a left-turning vehicle, Delaware permits using the shoulder if necessary. That exception does not make every shoulder a passing lane. Watch for bicycles, pedestrians and turning vehicles.
