A police officer arrests you for driving while intoxicated and asks you to take a breath test at the station. Under New York law, what is this test for, and why are you expected to take it?
Correct answer: To measure your BAC, since you agreed to it by choosing to drive in New York
Why
Chemical tests can use breath, blood, urine or saliva. New York's implied consent law says that anyone who drives in the state has already agreed to such a test when an officer lawfully requests it, for example after an arrest for an alcohol or drug offense. Refusing brings its own license penalties, separate from the DWI case. A driver involved in a crash or stopped for a traffic violation can also be asked to take a roadside breath screening test.
