Safe & Responsible DrivingStandalone practice
An officer arrests a driver for OVI and asks for a chemical test. The driver has no earlier OVI conviction or test refusal, and refuses the test. What happens under Ohio's implied consent law?
Correct answer: The license is suspended at once for one year, even if the driver is found not guilty.
Why
By driving in Ohio, you are deemed to consent to a chemical test of your blood, breath, plasma, urine or oral fluid if an officer arrests you for OVI. The suspension grows with each earlier refusal or OVI conviction in the past 10 years. A driver who takes the test may also get an independent test at his or her own cost.
