A 30-year-old driver is stopped at night, and a breath test shows an alcohol concentration of exactly 0.08. What does this result mean under Oklahoma law?
Correct answer: It is at the DUI level, because an adult at 0.08 or more breaks the law.
Why
A test result at or above 0.08 is enough for a DUI charge, and it can also lead to revocation of the driver license even without a court conviction. A result above 0.05 but below 0.08 can still be used as evidence that alcohol impaired your driving, and an officer's observations can support a conviction without a test. Impairment starts well below the legal limit, so the only safe amount of alcohol before you drive is none.
