Passing target: 80% (32/40)
May a driver cross left of center to pass when approaching a hillcrest or curve with an obstructed view?
Correct answer: No; wait until you can see enough and passing is lawful.
Why
For an ordinary left-of-center pass on a two-way road, wait if a hillcrest or curve obstructs the view so that the maneuver could be hazardous. The statute also restricts left-of-center travel within 100 feet of an intersection or railroad crossing, and within 100 feet of a bridge, viaduct or tunnel when the view is obstructed. Section 32:76 provides exceptions for one-way or multilane highways and specified left turns into or from an alley, private road or driveway; those do not justify the unsafe ordinary pass described here.
