You are in the right lane of a three-lane highway. Ahead, a pickup truck is stopped on the right shoulder with its hazard lights flashing. The center lane is clear, and no officer is directing traffic. What does New Jersey law require you to do?
A travels in the right lane of a three-lane highway. A pickup with hazard lights flashing is stopped on the right shoulder, and the center lane is clear.
Correct answer: Move into the center lane, which is not next to the stopped truck, because it is safe to do so.
Why
New Jersey's Move Over law, as amended by P.L.2025, c.248 (in force since January 12, 2026), covers any stationary vehicle that shows flashing or blinking lights; it no longer lists vehicle types, flares or triangles. Approach with care, and move to a lane that is not next to the stopped vehicle when traffic and safety allow. If a lane change is impossible, illegal or unsafe, slow to a reasonable speed below the posted limit and be ready to stop. The 2026 manual still gives the older list of vehicles, flares and triangles, but the statute now depends only on the flashing or blinking lights.
