Safe & Responsible DrivingStandalone practice
An officer arrests a driver for DWI and asks for a breath test. The driver refuses. What can happen to the driver's license?
Correct answer: It can be revoked for one year.
Why
Under New Mexico's Implied Consent Act, anyone who drives in the state is considered to have agreed to breath or blood tests for alcohol or drugs if arrested for DWI. If a driver refuses after being told that refusal can cost the license, the MVD revokes it for one year or until all reinstatement conditions are met, whichever is later. This revocation is separate from any penalty for a DWI conviction.
