A driver with a blood alcohol concentration of 0.09 is arrested for DUI. Her 16-year-old son rides in the back seat. Under current Oklahoma law, which charge applies?
Correct answer: Aggravated DUI, a felony, because a passenger under 18 was in the car
Why
Current Oklahoma law makes a DUI aggravated when the driver also has a BAC of 0.15 or more, causes a reportable crash, breaks a lane or wrong-way rule, eludes the police, drives more than 20 mph over the limit (10 mph in an active school zone), drives recklessly, or carries a passenger under 18. An aggravated DUI conviction brings mandatory jail time, supervision and an ignition interlock device. The manual does not describe aggravated DUI yet.
