Safe & Responsible DrivingStandalone practice
A 40-year-old driver of a passenger car feels alert, but his breath test shows a BAC of exactly 0.08%. What does this result mean under Tennessee law?
Correct answer: It is DUI, because 0.08% or more is the per-se limit for adult drivers.
Why
BAC measures the share of alcohol in the blood: at 0.08%, there are 8 drops of alcohol in every 10,000 drops of blood. A BAC below 0.08% does not clear a driver, because a driver who is impaired by alcohol or drugs can be convicted of DUI at any level, even at 0.00%. Driving skills, judgment and vision are clearly affected at levels as low as 0.03% to 0.04%.
