Passing target: 70% (28/40)
You drive at the posted 60 mph in the right lane of a highway with two lanes in your direction. A police car with flashing lights is stopped on the right shoulder. Heavy traffic in the left lane stops you from moving over. What must you do?
Blue A travels in the right of two eastbound lanes. Three silver cars occupy the left lane. A black-and-white police SUV is wholly on the right shoulder; a dashed lightbar annotation and caption identify flashing lights. The posted speed is 60 mph. No response or reduced speed is shown.
Correct answer: Slow to 40 mph or less until you pass it, 20 mph below the posted limit.
Why
Officers and crews who work next to traffic are in danger from passing cars, so Texas requires you to move out of the closest lane or to slow down. When the posted limit is less than 25 mph, you must slow to 5 mph or less. The rule also covers stopped tow trucks, TxDOT and utility vehicles with warning lights and, since September 1, 2025, animal control and parking-citation vehicles that use approved warning lights.
