Jaden, 16, has a Level 1 instruction permit. His school play ends at 10:30 p.m., and his licensed mother, age 45, will sit beside him. May Jaden drive home?
Correct answer: No. A Level 1 permit holder may drive only from 5 a.m. to 10 p.m., even with a supervisor.
Why
Late-night driving is the most dangerous time for new drivers, so West Virginia limits Level 1 practice to daytime and evening hours. The exceptions for work, school-sanctioned activities, religious events and emergencies apply only to a Level 2 driver who drives without a supervisor between 10 p.m. and 5 a.m. Other Level 1 rules: no more than two non-family passengers in addition to the supervisor, a safety belt for every occupant, no measurable alcohol, and no phone use except to call 9-1-1.
