Passing target: 80% (24/30)
You are driving in the right lane of a four-lane divided highway, with two lanes in your direction. Ahead, a tow truck is stopped on the right shoulder with its amber lights flashing. The left lane is clear. What does West Virginia law require you to do?
A travels in the right of two lanes beside a stopped tow truck on the right shoulder. The truck’s amber lights flash and the left lane is empty; no lane-change route is drawn.
Correct answer: Move into the left lane, away from the tow truck, when it is safe, and keep a safe speed.
Why
West Virginia's move-over law (W. Va. Code 17C-14-9a) covers any stationary vehicle that shows flashing emergency or warning lights, hazard lights, flares or a reflective warning sign. On a road with two or more lanes in your direction, change to a lane that is not next to the stopped vehicle when it is safe. If you cannot change lanes safely, slow down to a safe speed of not more than 15 mph on an undivided road or 25 mph on a divided highway. People who work beside moving traffic are at high risk, and one empty lane gives them a margin of safety.
