You drive on a highway with two lanes in your direction. A car is stopped on the right shoulder with its hazard lights flashing, and its driver stands next to it. The left lane is clear, and you can change lanes safely. What does Wisconsin law require?
A approaches a silver car stopped on the right shoulder with its driver beside it. The fact card states flashing hazard lights and a clear left lane.
Correct answer: Move into the left lane, and stay there until you are safely past the stopped car.
Why
The Wisconsin move-over law applies to a vehicle that is stopped on the road or within 12 feet of it. It covers emergency vehicles with flashing lights, tow trucks, highway maintenance vehicles and utility vehicles with flashing lights. Since December 11, 2025, it also covers a disabled vehicle with hazard lights, flares or warning devices, or people next to it. The handbook names only emergency vehicles and police cars, but the law is wider. The extra space protects people who stand close to fast traffic.
