Safe & Responsible DrivingStandalone practice
A 30-year-old driver's test shows a BAC of 0.06 percent, which is below 0.08. The officer also saw the car weave and the driver react slowly. Can the driver still be convicted of DWUI in Wyoming?
Correct answer: Yes, if the evidence shows alcohol made the driver unable to drive safely.
Why
Wyoming makes it illegal to drive with a BAC of 0.08 percent or more, and also to drive when alcohol makes you incapable of driving safely. When a BAC is more than 0.05 but less than 0.08, the law makes no presumption, and a court can use it with other evidence such as weaving or slow reactions. Impairment starts well before 0.08, so the only safe plan is not to drive after drinking.
