Passing target: 80% (24/30)
You are driving on a Montana interstate where the posted limit is 80 mph. A highway patrol car is stopped on the shoulder ahead with its emergency lights on. No temporary speed limit is posted, and heavy traffic beside you keeps you from moving to another lane. What does current Montana law require?
A is in the interstate’s right lane with heavy traffic beside it. A patrol SUV is stopped entirely on the right shoulder; a card states that its emergency lights are on and the limit is 80 mph.
Correct answer: Slow to half the posted limit, 40 mph here, and pass the patrol car with care.
Why
Montana's current move-over law covers stationary police, emergency and highway worker vehicles that show emergency lights. On the interstate you slow to 20 mph below the limit if you can move to another lane, or to half the limit if you cannot; on state highways and county roads the reduction is 30 mph below or half, and on other roads it is half. On a multi-lane road, move to a lane that is not next to the stopped vehicle when you safely can. The printed manual still describes an older 20 mph rule, so use the current law.
