Safe & Responsible DrivingStandalone practice
An adult driver has a BAC of 0.05 percent after two beers. An officer sees the car drift across lanes and finds that the driver's judgment is clearly impaired. Can the driver be convicted of DUI?
Correct answer: Yes. A driver whose ability to drive is impaired can be convicted of DUI at any BAC.
Why
Tennessee law defines DUI in two ways: driving while impaired by any intoxicant or drug, or driving with a BAC of 0.08 percent or more. Judgment and vision are affected at levels as low as 0.03 to 0.04 percent. A driver can even have a BAC of 0.00 and be convicted of DUI for drug impairment.
