Arkansas Hardship License (Age Waiver): Who Qualifies Under 16

informational·how to guide·

Where the Arkansas age waiver rules come from

The waiver rules come from the DFA Age Waiver Information page, which cites Arkansas Code section 27-16-804. The 16- and 17-year-old waivers and the Learner's License ages come from the DFA Learner's and Intermediate License page. The permit and Learner's License steps come from the Arkansas Driver License Study Guide (Arkansas State Police, October 2026). The phone rule comes from Act 394 of 2009, the intermediate license age from Act 928 of 2025, and the financial responsibility rules from the DFA Graduated Licenses page and the ASP-33 form. This guide is current as of 2026. Confirm the rules with the Arkansas DFA Office of Driver Services (dfa.arkansas.gov) and the Arkansas State Police before you drive.

What is an Arkansas age waiver?

An age waiver, also called a hardship license, is a restricted waiver for a minor under 16. The DFA Office of Driver Services may issue it to a minor who shows need under Arkansas Code section 27-16-804. Only applicants with verifiable documentation of a true hardship, one that would cause extreme privation or suffering, should apply.

Who qualifies for an age waiver

  • The applicant holds a valid Arkansas license with the correct address on it. Under 16, that is the Learner's License.
  • The applicant has at least six months of driving experience, counted from the date the permit was issued.
  • The applicant has no at-fault accidents, traffic violations or suspensions, in Arkansas or in another state.
  • If someone other than a parent has legal custody, a copy of the custody documents goes with the application.

How to apply for an Arkansas age waiver

  1. 1
    Gather your documents

Collect the proof of hardship and the DFA forms: the Age Waiver Application and the insurance, work, school and medical verification forms. All letters must be signed and dated within the last 30 days.

  2. 2
    Apply online

Submit the application through MyDMV.Arkansas.gov. Incomplete applications are denied, so check each document before you send it.

  3. 3
    Request a hearing

When all documents are gathered and the application is complete, contact your local Driver Control Office to request a hearing.

  4. 4
    Attend the hearing in person

All age waiver hearings are in person. The parent or guardian who agreed to be financially responsible and the young driver must both be there.

What must the parent or guardian do?

The parent or guardian needs an Arkansas driver's license or ID card. The person who signs the waiver application must be the same person who signed for financial responsibility. Under Arkansas Code section 27-16-702, a parent or guardian must accept financial responsibility before any applicant under 18 gets a license. On the ASP-33 form, a parent or legal guardian signs this statement before a notary. The law treats any negligence or willful misconduct of the minor while driving as the responsibility of the person who signed the application.

What comes before an age waiver?

A minor starts with an Instruction Permit at age 14 or older, after passing the knowledge exam and the vision test. The permit is valid for two years from the passed knowledge exam. For a Learner's License, the permit must show that the knowledge exam, vision test and skills test are complete. Then the minor visits any Arkansas Revenue Office to get the license. The Arkansas Learner's License guide has the full steps.

Learner's License rules for ages 14 and 15

The Learner's License is for ages 14 and 15. The driver must be accompanied by a licensed driver who is at least 21, and all passengers must wear seat belts. Under Act 394 of 2009, a driver with a Learner's License must not use a cell phone or other wireless device while driving, except for an emergency purpose.

What do the 16- and 17-year-old waivers give?

Arkansas residents who are 16 or 17 may get an unrestricted Class D license before their 18th birthday if they meet one of the conditions in the table. All four waiver types need six months of driving experience. These waivers are separate from the hardship age waiver, which is only for a minor under 16.

Key takeaways

  • An Arkansas age waiver (hardship license) is for a minor under 16 with verifiable documentation of a true hardship.
  • The minor needs a valid Arkansas license, six months of driving experience from the permit date, and no at-fault accident, traffic violation or suspension.
  • Apply online at MyDMV.Arkansas.gov, then request an in-person hearing with Driver Control. The parent and the minor must both attend.
  • A waiver never allows driving before 6 a.m., after 9 p.m., more than 30 miles one way or out of state. A moving conviction, a broken provision or an at-fault accident revokes it.

Arkansas age waiver: common questions

Can an age waiver cover driving to a part-time job?

Only some jobs. DFA does not grant a waiver for work that needs delivery services, a company vehicle, lawncare, babysitting or driving to several jobsites. For other work, DFA has an Age Waiver Work Verification form. Each letter must be signed and dated within the last 30 days.

Can my teen drive to school sports practice with an age waiver?

Only if it is a school activity. DFA issues no age waiver for extracurricular activities outside of school activities, such as a club or a private team. A school practice must also fit the waiver limits: no driving before 6 a.m. or after 9 p.m., and no more than 30 miles one way.

Can a grandparent apply for an age waiver?

Yes, when the grandparent is the legal guardian. Send a copy of the legal custody documents with the application. The guardian needs an Arkansas driver's license or ID card and must be the same person who signed for financial responsibility. The guardian and the teen must both attend the in-person hearing.

How long does an Arkansas age waiver last?

A waiver for an extracurricular activity is granted only for the time that the activity is in effect. Driver Control may also review any waiver at any time to decide whether it is still needed. At 16 or older, a teen can apply for an intermediate license under Act 928 of 2025. The Arkansas intermediate license guide explains its rules.
