When Does a Delaware Permit Become a Class D License? 12-Month Rule
When does a Delaware learner's permit turn into a Class D license?
A Delaware teen can get a Class D license after holding a Level 1 Learner's Permit for at least 12 months, if the teen is at least 17 and the sponsor has not withdrawn the endorsement. The Division of Motor Vehicles then notifies the permit holder by mail that the holder is eligible. Time under suspension does not count toward the 12 months.
Where the Delaware 12-month rule comes from
The 12-month rule is in Delaware Code Title 21, section 2710. The suspension, test and fee rules come from sections 2701, 2707, 2713 and 2715 of the same title. The Delaware Driver Manual (July 2026) explains the program for drivers, and the DMV guide for new residents (2026) gives the current Class D fee. This guide is current as of 2026. Confirm the rules with the Delaware DMV (dmv.de.gov) before you drive.
What the 12-month rule says
A Delaware teen can get a Level 1 Learner's Permit from age 16, after driver education and the written and road skills tests. A minor can get a Class D license at 17 or older, after at least 12 months on the permit. The same rule applies from 17 to under 22 for a person in special education under an active Individual Education Program (IEP).
The law says the Division of Motor Vehicles notifies the permit holder by mail of the Class D eligibility, and the Delaware Driver Manual says the permit "will automatically convert" after 12 full months of valid driving authority.
The 12 months, step by step
- 1Months 1 to 6: supervised driving only
For the first 6 months, the permit holder may only drive with a supervisor.
- 2End of month 6: certified practice hours
Before the permit holder may drive alone, a parent or guardian certifies 50 hours of driving, including 10 hours at night. The certification is turned in at the end of the first 6 months. The free question on required supervised practice hours covers this rule.
- 3Months 7 to 12: limited solo driving
The permit holder may drive alone from 6:00 a.m. to 10:00 p.m. From 10:00 p.m. to 6:00 a.m., a supervisor must ride along, except on trips to and from church activities, work and school. With no supervisor in the vehicle, only 1 other passenger is allowed.
- 4After month 12: the Class D notice
If the sponsor has not withdrawn the endorsement, the Division sends the mail notice that the holder is eligible for a Class D license. The privileges must not be suspended, revoked, canceled, denied or surrendered at that time.
Which permit rules apply until the Class D license?
All Level 1 permit limits stay in force for the full 12 months. The guide to Level 1 permit supervision, curfew and passengers lists the supervisor, curfew and passenger rules. A permit holder may not use a cell phone or a similar electronic device while driving, unless the vehicle is stopped off the travel lanes. Breaking any permit restriction is unlawful and counts as driving without a license.
What can delay or cancel the Class D license?
Which violations suspend a Level 1 permit?
A permit restriction violation brings a 2-month suspension for a first offense and 4 months for each later offense. The Department can also suspend a minor at once for reckless or negligent driving or for a serious moving violation. Phone use on a permit counts as negligent driving. A person suspended on a Level 1 permit is re-examined before reinstatement. The free question on night driving with a Level 1 permit shows one rule that can lead to a violation.
What does the sponsor's signature control?
- The sponsor signature on the permit application also authorizes the Class D license when the minor is eligible.
- The sponsor decides if the minor is ready to drive and who may supervise the permit holder.
- The sponsor can withdraw the endorsement in writing at any time until the minor turns 18.
- Before 18, an approved sponsor must sign again to reinstate canceled privileges.
- At 18, the person can reinstate the earlier privileges without a sponsor signature.
I am 18 or older with a Level 1 permit. Can I take the DMV tests?
A Level 1 permit holder who is 18 or older can finish the 12-month program or choose to take the eye, written and road skills exams at the DMV, according to the Delaware Driver Manual. At 18 or older, the graduated program is optional, and a person who opts out needs no sponsor. If you are an adult who has no permit yet, read the guide to the Temporary Instruction Permit for adults 18 and older.
Class D license fee and term
| Item | Detail |
|---|---|
| Class D fee (U.S. dollars) | $50 (section 2715 and the 2026 DMV guide) |
| License term | 8 years: it expires on the 8th birthday anniversary after issue |
| No fee | A child in the custody of the Department of Services for Children, Youth, and Their Families |
Why do some Delaware sources show a $40 fee?
The Level 1 permit section of the law (section 2710) still names a $40 Class D fee, and so did the 2024 Delaware Driver Manual. Section 2715, which sets the license fee at $50, the 2026 DMV guide and the July 2026 Driver Manual are newer and all give $50, so use $50. A teen pays the Class D license fee at the first permit application, and the license fee includes the cost of the learner's permit. Confirm the amount with the Delaware DMV before you pay.
Key takeaways
- A Delaware teen can get a Class D license after at least 12 months on a Level 1 Learner's Permit, at age 17 or older.
- The Division notifies the permit holder by mail when the holder is eligible, if the sponsor has not withdrawn the endorsement.
- Suspended time does not count, so a suspension pushes the license date later.
- The sponsor can cancel the driving authority until the minor turns 18. An expired permit is void.

Delaware permit to Class D: common questions
Can I get a Delaware Class D license at 16?
No. The youngest age for a Class D license under the 12-month rule is 17. A teen can get the Level 1 Learner's Permit at 16, after driver education and the written and road skills tests, and must then hold the permit for at least 12 months. The sponsor must not withdraw the endorsement in that time.
Do I need to take a new test to get the Class D license?
Not in the normal case. The Class D rule asks for at least 12 months on the Level 1 Learner's Permit and an application signed by a sponsor, and you pass the written and road skills tests before the permit. A new exam applies after a suspension, because you are re-examined before reinstatement, and after an expired permit.
Does driving on my driver education learner's permit count?
Yes, for the practice rules. Driving on a driver education learner's permit counts toward the supervised driving experience of the first 6 months on the Level 1 Learner's Permit, which includes the 50 certified hours. The 12 months for the Class D license are counted on the Level 1 Learner's Permit itself.
Who can sign as my sponsor for a Delaware permit and license?
Your parent, guardian, Division of Family Services case worker or court-ordered custodian who lives in Delaware. If none of them lives in the state, another responsible adult who lives with you in Delaware and is acceptable to the Secretary of Transportation may sign.
