Can International Students Drive in Florida on a Home Country License?
Can international students drive in Florida on a home country license?
Florida law, s. 322.031(3), says a nonresident enrolled as a full-time student at a qualifying college is "also exempt" from getting a Florida driver license for the duration of enrollment. The Florida driver handbook also lists any nonresident attending college in Florida who holds a valid license from home as exempt. The same law says a nonresident who accepts a job must get a Florida license within 30 days.
Where these facts come from
The student and job rules come from s. 322.031 of the 2026 Florida Statutes; sections 322.04, 322.095 and 322.12 give the visitor rule, the course rule and the tests. The handbook quotes come from the Official Florida Driver License Handbook. The documents come from the FLHSMV non-immigrant What to Bring page, with the What to Bring FAQ, the general information FAQ, the visiting Florida FAQ and the Class E exam page. This guide is current as of 2026. The handbook is older than the latest law changes: where they differ, the law wins. Confirm the rules with the Florida Department of Highway Safety and Motor Vehicles (flhsmv.gov) before you drive.
What Florida law says about nonresident students
Section 322.031(3) holds the student rule. Its last sentence reads: "A nonresident who is enrolled as a full-time student in such institution of higher learning is also exempt from the requirement of obtaining a Florida driver license for the duration of such enrollment."
It follows a rule for a nonresident student in a work-study program of up to 6 months, who needs no Florida license for that program "if such person has a valid driver license issued by another state." "Such institution" means a college whose credits or degrees at least three accredited institutions of higher learning accept for credit.
What the Florida driver handbook says about college students
The handbook has a section called "Exceptions for the Florida Driver License". It says that some people "are also exempt if they hold a valid driver license from their state/country". The list includes "Any non-resident attending college in Florida."
The same section names "an International Driving Permit from your country of residence accompanied by a valid driver license from that country" as one way a nonresident of age 16 or older is exempt.
If this is your situation, read this rule
The visitor rule and the meaning of "resident"
Section 322.04(1) lets a nonresident aged 16 or older drive a Class E vehicle with a valid noncommercial license from the home state or country in immediate possession, if the license is not invalid under s. 322.033. Under s. 322.04(2), this rule does not apply to a person covered by s. 322.031.
FLHSMV pages define "resident" in different ways. The visiting FAQ says to get a Florida license "within 30 days of becoming a resident", and its list includes "Accept employment" and "Reside in Florida for more than six consecutive months." The handbook uses a "principal place of domicile in Florida" for more than six consecutive months.
Documents for an F-1 or J-1 license applicant
- Primary identification: a valid employment authorization card (form I-688B or I-766), or a non-expired I-94 with the required supporting documents.
- An I-94 must come with a valid passport that has a date of entry stamp.
- With the I-94: an I-20 for an F-1 or M-1 classification, or a DS2019 for a J-1 or J-2 designation.
- Proof of a Social Security number (SSN): a Social Security card, W-2 form, pay check or stub, SSA-1099 or any 1099. The next table gives the two FLHSMV texts for applicants without an SSN.
- Two different documents that show your Florida residential address. Out-of-state and U.S. territory addresses are no longer accepted for a Class E license.
No SSN: what two FLHSMV pages say
| FLHSMV page | Text |
|---|---|
| Non-immigrant What to Bring page | "Non-immigrants in the country without a work visa are not required to obtain a letter from the Social Security Administration stating that they were never issued an SSN." |
| What to Bring FAQ | "Individuals with a non-immigrant status must also provide proof of a social security number, unless their immigration status does not authorize them to work in the U.S." It adds that non-immigrants with work authorized documents who are not work authorized "must obtain a letter of ineligibility from SSA indicating they are not eligible to obtain an SSN." |
Card validity and the temporary paper permit
A license for a non-immigrant "will be issued for the period of time specified on the USCIS document, not to exceed one year."
A non-U.S. citizen who applies for an original driver license gets "a 60-day temporary paper permit without a photo and a receipt." After identity and legal status checks, the license "will be issued within 60 days and mailed to the address on the driver record." If lawful status or identification is not verified, FLHSMV mails a denial of issuance letter.
Which Florida tests an international student may take
Section 322.12(1) says the department "may waive" the knowledge and skills tests for an applicant who surrenders a valid license from another state, a province of Canada or the U.S. Armed Forces. Under s. 322.12(2), the department examines every applicant, "including an applicant who is licensed in another state or country", unless the chapter says otherwise.
An FLHSMV FAQ says persons with licenses from other countries "may need" a 4-hour Traffic Law and Substance Abuse Education course, a written exam or a driving test.
Course, foreign license and exam language
- Under the 2026 law, s. 322.095(1), only an applicant 18 or older never licensed in another jurisdiction, and without a Department of Education driver education course, must take the traffic law and substance abuse course. The Florida TLSAE and DETS course guide explains which course applies to you.
- For a license from your home country, read the rules for a foreign driver's license in Florida, with the handbook list of countries.
- "Class E knowledge examinations are available in English only." Our free practice tests are in English only too.
Key takeaways

- An F-1 applicant brings an I-20 with the I-94, and a J-1 applicant brings a DS2019.
- A non-immigrant license lasts as long as the USCIS document, and not more than one year.

Florida license for international students: common questions
Does my spouse need a Florida license if I am a student?
The 30-day rule for a spouse or dependent child in s. 322.031(1) is tied to a nonresident who accepts a job or enters children in Florida public schools. In those cases, the spouse or child must get a Florida license within that 30-day period before driving on Florida highways. For the family of a full-time student, ask FLHSMV.
Do I need an International Driving Permit to drive in Florida?
Florida law, s. 322.04(1), lets a nonresident drive with a valid noncommercial license from the home state or country in immediate possession. The Florida driver handbook also names an International Driving Permit, together with a valid license from your country of residence, as one way a nonresident of age 16 or older is exempt from a Florida license.
My I-20 or DS-2019 expires soon. Can I still get a Florida license?
FLHSMV says the documents of a non-immigrant applicant must be valid for more than 60 days from the date of issuance. The license is then issued for the period on the USCIS document, not more than one year. A renewed license for a non-immigrant also follows the time that USCIS approves, again not more than one year.
Do I need a vision test for a Florida license?
Yes. The FLHSMV general information FAQ says "A vision test is required for all original issuances." The handbook also says that a vision exam is still required when the knowledge and skills exams are waived for a license on its reciprocity list.
