Kentucky Instruction Permit Rules for Teens: Curfew and Passengers

informational·how to guide·

Where the Kentucky permit rules come from

The supervising driver, curfew, passenger and 180-day rules come from the Kentucky law on instruction permits, KRS 186.450. The phone ban comes from KRS 189.294, with the device definition in KRS 189.292 and the fine in KRS 189.990. The intermediate license rules come from KRS 186.452, and the No Pass/No Drive rule from KRS 159.051. The Kentucky Driver Manual (updated July 23, 2026) and the Kentucky State Police driver testing page give the same permit rules and the test details. This guide is current as of 2026. Confirm the rules with the Kentucky Transportation Cabinet (drive.ky.gov) and the Kentucky State Police before you drive.

Who must ride with you on a Kentucky permit?

A person with a valid operator's license, at least 21 years old, must occupy the seat beside you at all times while you drive. This means the front passenger seat. A brother or sister who is 19 does not count, and a licensed driver in the back seat does not count. You must also keep the permit with you whenever you drive. The only exception is a multiple-vehicle driving range where an instructor from a licensed driving school or a school supervises you.

How many passengers can a teen with a permit carry?

  • You may not drive with more than one unrelated person under 20 in the vehicle.
  • Your brothers, sisters and other relatives do not count toward the limit, so a family can ride together.
  • The limit does not apply when an instructor from a licensed driving school or a school is in the car.
  • The limit also does not apply to a driver of an agricultural vehicle registered under KRS 186.050(4) who is doing agricultural work.
  • A police officer cannot stop you only for the passenger limit, but the rule still applies, and a violation delays your intermediate license (see below).

When can a permit holder under 18 not drive?

You may not drive between 12 midnight and 6 a.m. unless you can show good cause for driving. The law names emergencies, school-related activities and work-related activities as examples of good cause, and the list is not limited to these. Plan your trips so that you are off the road by 12 midnight. If you must drive later, for example after a late work shift or a school event, be ready to show your reason.

Can a teen with a permit use a phone while driving in Kentucky?

  • No. A person under 18 with an instruction permit, an intermediate license or an operator's license may not drive a moving vehicle on the traveled part of a road while using a personal communication device.
  • A personal communication device is any device that can send or receive two-way audio or text communication and signals or shows a message, such as a cell phone.
  • The only exception is a call to summon medical help or a law enforcement or public safety agency in an emergency.
  • A built-in navigation system or a stand-alone GPS is not "use", but typing an address into the GPS feature of your phone is.
  • The fine is $25 for a first offense and $50 for each later offense.

What happens if a teen with a permit breaks a rule?

You drive without the permit with you, without a supervising driver who is 21 or older, during the curfew without good cause, or with too many passengers
At least 180 days are added, counted from the date of the violation, before you can apply for an intermediate license.
You get a moving violation that carries points, or a DUI conviction
The same 180 days are added from the date of the violation.
You are convicted of a phone violation under KRS 189.292 or 189.294 during the permit period
You cannot apply for the intermediate license until you have held the permit 180 days without that conviction.
You are under 18 and collect more than six points, which means 7 or more
Your driving privilege can be suspended, or the court can probate it. Our guide to Kentucky teen driver points and penalties explains the details.
You are 15 to under 18, and you drop out of school or the school declares you academically deficient
You can lose your permit under the No Pass/No Drive law. Time you spend suspended under this law does not count toward your 180 permit days.

How the rules shape your wait for an intermediate license

You can get a permit at 15. At 16 or 17, you must hold your permit at least 180 days before you apply for an intermediate license, and each violation above pushes that date back. You also need a parent-signed Practice Driving Log that lists 60 hours of supervised driving, with at least 10 of them at night. Our guide to the Kentucky intermediate license covers the road skills test and the steps to apply. Your permit stays valid for four years and can be renewed.

Can you drive yourself to the road test?

No, not alone. The supervising driver rule also applies on the way to your road skills test, so a licensed driver who is at least 21 must ride in the seat beside you. If you drive to the test site alone, or break another traffic law there, the test will be rescheduled.

Key takeaways

  • A licensed driver who is at least 21 must sit beside you at all times, and you must carry the permit.

  • You may not use a phone while the vehicle moves, except to call for help in an emergency. The fine is $25 for a first offense and $50 after that.

Kentucky permit rules for teens: common questions

Can my parent supervise me on a Kentucky permit?

Yes, if your parent has a valid operator's license and is at least 21 years old. Any licensed driver who meets both conditions can sit beside you. Your parent or legal guardian also signs your permit application when you are under 18.

Can I drive to work after midnight with a Kentucky permit?

Yes, if the trip is a work-related activity, because work is one of the examples of good cause in the law. Be ready to show the reason. The supervising driver rule still applies, so a licensed driver who is at least 21 must be in the seat beside you.

Do my younger siblings count toward the passenger limit?

No. The limit counts only unrelated people under 20. Your brothers, sisters and other relatives can ride with you, and one unrelated person under 20 can ride along as well.

Does a permit holder who is 18 or older follow the same curfew?

No. The curfew, the passenger limit and the 180-day rule apply to a permit holder under 18. Adults with a permit still need a licensed driver who is at least 21 in the seat beside them.

Can I use my phone for music or maps with a permit?

You can use a built-in navigation system or a stand-alone GPS unit. You cannot use your phone while the vehicle moves on the road, and this includes typing an address into its GPS feature. The only exception is a call for help in an emergency. Set your route and your music before you start to drive.
