NJ Learner Permit: Special Learner Permit at 16 vs Examination Permit at 17

informational·how to guide·

Where the New Jersey permit rules come from

The rules come from the New Jersey Motor Vehicle Commission (MVC) young adult page, the MVC first license page and the New Jersey Driver Manual (2026). The decal, fee and 50-hour details come from the MVC Graduated Driver License (GDL) page, the MVC fee table, forms BA-412D and BA-CSD, and a January 2025 MVC release. This guide is current as of 2026. Confirm the rules with the New Jersey Motor Vehicle Commission (nj.gov/mvc) before you drive.

Special learner permit at 16: how it works

New Jersey's Graduated Driver License (GDL) program has two permit routes. The special learner permit starts at 16 and runs through a high school or a licensed driving school. MVC pages also call it the special learner's permit or the Student Learner's Permit. You must be enrolled in a behind-the-wheel course, and you take the knowledge test and the vision test at the school. The examination permit starts at 17 and needs no school.

The special learner permit lets you start practice earlier, but it does not get you a license earlier. You cannot get your probationary license before age 17.

Steps to get a special learner permit at 16

  1. 1
    Enroll in a course

Sign up for a behind-the-wheel course at a high school or a licensed driving school. A parent or guardian must sign consent.

  2. 2
    Fill in form BA-412D

Complete the form and show your documents at the school. The school certifies that you are enrolled in an approved course, and your instructor buys the $10 permit.

  3. 3
Pass the knowledge test and vision test

You take both at the school. If you fail the knowledge test, you can retest in 7 days.

  4. 4
Finish 6 hours with the instructor

Drive six full hours with a licensed driving instructor in a dual-controlled car.

  5. 5
    Get the permit validated

You, a parent or guardian, or the driving school completes the permit at an MVC Licensing Center with a Driver Testing Center. Do not practice drive until the MVC validates it.

Which New Jersey permit is right for you?

You are 16 and want to start now
Enroll in a behind-the-wheel course at a high school or licensed driving school. The examination permit starts at 17.
You are 16 and do not want a course
Wait until 17 and apply for the examination permit.
You are 17 to 20 and live in New Jersey
Apply for the examination permit at any MVC Licensing Center, unless your driving privileges are suspended. A driving school course is your choice.
You are 21 or older
Use the examination permit. You need at least three months of supervised driving, and the hour, passenger and decal limits do not apply.

Who can supervise a New Jersey permit driver?

The supervisor rule is the same for both permits. Your supervising driver sits in the front seat, is at least 21, holds a valid New Jersey driver license and has at least three years of driving experience. An older brother or sister who is under 21 cannot supervise you. The practice question on who may supervise a 16-year-old permit driver tests this rule.

New Jersey permit limits: hours, passengers, phone and decals

  • No driving from 11:01 p.m. to 5:00 a.m. Work or religion can be an exemption, with proof that you need to drive in those hours.
  • Passengers: a parent, guardian or your own child (a dependent), plus one more passenger. The one-passenger limit does not apply when a parent or guardian is in the car. Try the practice question on who may ride with a special learner permit driver.
  • No cell phone, hand-held or hands-free, and no handheld video game or other interactive wireless device.
  • Seat belts at all times.
  • Two red reflective GDL decals (Kyleigh's Law): one on the upper left corner of the front plate and one on the rear plate. A pair costs $4 at an MVC agency. A GDL violation, or missing decals, carries a $100 fine.
  • At 21 or older, the hour, passenger and decal limits do not apply. The supervisor, phone and seat belt rules stay.

How long must you hold the permit before the road test?

Plan on at least six months of supervised driving before the road test, or three months if you are 21 or older. Check the date on your permit with the MVC before you book. If you got your permit under 21 on or after February 1, 2025, the supervised driving must include at least 50 hours, 10 of them in darkness. A parent, guardian or supervising driver confirms the hours on form BA-CSD. Bring the signed form to your road test and to the Licensing Center when you get your license. See how the 50-hour rule works before you start.

Key takeaways

  • At 16, get a special learner permit through a high school or licensed driving school: a 6-hour course with an instructor, who buys the $10 permit.
  • At 17, buy an examination permit yourself at an MVC Licensing Center, with no course. Under 18, a parent or guardian must consent.
  • Always drive with a supervisor who is 21 or older, holds a valid New Jersey license and has three years of experience. Under 21, also follow the 11:01 p.m. curfew, the passenger limit and the decal rule.
  • Hold the permit for at least six months of supervised driving (three months at 21 or older), and finish the steps within two years.

New Jersey learner permit: common questions

Do I need a driving school to get a permit at 17?

No. The examination permit needs no course and no instructor, and you do not have to be a student. You buy the $10 permit yourself at an MVC Licensing Center. The MVC validates it for practice after you pass the knowledge test and the vision screening. A driving school is required only for the special learner permit at 16.

Where do I take the permit knowledge test at 16?

At your high school or licensed driving school, together with a vision test. If you fail, you can retest in 7 days. A pass does not let you practice yet: after your 6 hours with the instructor, the MVC validates the permit at a Licensing Center with a Driver Testing Center.

Can my brother or sister ride with me on a permit?

Yes, but only as your one additional passenger. A brother or sister is not a dependent, because a dependent is the driver's own child. If a parent or guardian is in the car, the one-passenger limit does not apply. The rule applies to permit holders under 21.

Does a New Jersey permit expire?

Yes. The special learner permit and the GDL examination permit are valid for two years. In that time you must finish the supervised practice, pass the road test and get your probationary license. If you do not, you must get a new permit.

Can I drive alone with a learner permit in New Jersey?

No. A permit holder must always have an adult supervising driver in the front seat. The supervisor is at least 21, holds a valid New Jersey license and has three years of driving experience. This rule stays at 21 or older. You can drive alone after you pass the road test and get your probationary license.
