Can International Students Drive in Virginia on a Home License?

informational·how to guide·

Where the Virginia student driving rules come from

The student, non-resident and new-resident rules come from the Virginia DMV eligibility page. The REAL ID, fee and permit rules come from the DMV page on applying for a license, the DMV 141 documents guide, the DMV 201 fee list and Code of Virginia § 46.2-324.1. The test rules come from the DMV page on exchanging a foreign license and the April 2026 Virginia Driver's Manual. This guide is current as of 2026. DMV can change the accepted documents without notice. Confirm the rules with the Virginia Department of Motor Vehicles (dmv.virginia.gov) before you drive.

Which Virginia driving rule applies to you?

You are a full-time student at an accredited Virginia school and you are not employed
You may drive with your valid home-country license. The vehicle may keep valid out-of-state plates.
You are a full-time student and you are employed
Virginia counts you as a resident for motor vehicle laws. Apply for a Virginia license and register your vehicle in Virginia.
You are a non-resident who lives in Virginia for a short time, and you are not a student
You may drive on your home license and plates for no more than six months. If you become gainfully employed, you must hold a Virginia license. The six-month rule does not apply to commercial vehicle drivers.
You move to Virginia to live
You must get a Virginia driver's license within 60 days of the move.

What changes if you work as an international student?

A full-time student who is employed is a Virginia resident for motor vehicle laws only. This status does not necessarily give you in-state tuition rates. You must apply for a Virginia license and register the vehicle in Virginia, even if someone else owns it. If you are not sure that your job counts as employment, ask DMV before you start it.

What F-1 and J-1 students bring to apply for a Virginia license

  1. 1
    Proof of identity

Bring an unexpired foreign passport with an unexpired U.S. visa and an unexpired or expired I-94 or entry stamp.

  2. 2
    Proof of legal presence

Bring the same passport and visa with an unexpired I-94 or entry stamp. F-1 applicants also bring an I-20. J-1 applicants also bring a DS-2019.

  3. 3
    Two proofs of Virginia residency

At least one must come from the primary list in DMV 141. The second can come from the primary or the secondary list.

  4. 4
    Social Security number proof

Bring it only if you were issued a number. You do not need the proof if you know the number and DMV can verify it electronically.

  5. 5
    Originals and the fee

DMV does not accept photocopies or temporary documents. The license fee is $4 per year, so a standard eight-year license costs $32. A REAL ID adds a one-time $10 fee.

How long does a Virginia license last for a temporary stay?

A REAL ID is valid for your period of authorized stay in the U.S., or for one year if the stay has no definite end date. Holders of a valid, unexpired nonimmigrant visa status can apply for one. A license that is not a REAL ID expires on your birthday and is valid for up to 8 years. When DMV approves your application, you get a temporary driving permit that is valid for 30 days. The license comes by mail in 7 to 10 days. The U.S. Postal Service does not forward it, so keep your address with DMV current.

Japanese licenses, the DL 7 and failed tests

The DMV exchange page lists Japan as a reciprocal country. The April 2026 Virginia Driver's Manual leaves Japan out of its lists of licenses that skip the knowledge exam and the road skills test. If you hold a Japanese license, ask DMV which tests you must take. If you hold a license from a reciprocal country but do not send a DL 7, you must meet all the knowledge and road skills testing requirements. If you fail the knowledge or road skills test, DMV no longer waives your tests.

Virginia student driving: common questions

Which proofs of Virginia residency can a student use?

You need two proofs, and at least one must be on the DMV 141 primary list. Primary proofs include a residential rental or lease agreement, a utility bill in your name that is not more than two months old, and a certified transcript or school record from the last year from an accredited school. DMV does not accept cell phone bills.

Can I use my work permit (I-766) for a Virginia REAL ID?

No. DMV does not accept the Employment Authorization Document (I-766) as proof of legal presence for a REAL ID. DMV 141 lists an unexpired I-766 as legal presence only for a license that is not a REAL ID. F-1 and J-1 students can show the passport, visa, I-94 and the I-20 or DS-2019 instead.

Do I need a REAL ID to fly inside the U.S.?

Since May 7, 2025, the federal government requires a REAL ID compliant driver's license or ID card to board a domestic flight. Holders of a valid, unexpired nonimmigrant visa status can apply for a Virginia REAL ID. It adds a one-time $10 fee to the license fee and is valid for your authorized stay in the U.S.

What is legal presence for a Virginia driver's license?

Legal presence means you are a U.S. citizen, a legal permanent resident or legally authorized to be in the U.S. in an eligible immigration status. Each first-time applicant for a standard license or ID in Virginia must show proof of it. For F-1 and J-1 students, the proof is the passport, visa, I-94 and the I-20 or DS-2019.
