Driver A and Driver B arrive at the same time at an intersection that has no signs or signals. Driver B is on Driver A's right, and both plan to go straight. Who must yield?
A and B approach an uncontrolled intersection at the same time. B is coming from the side on A’s right.
Correct answer: Driver A, because a driver must yield to a vehicle coming from the right
Why
At an intersection with no signs or signals, first yield to any vehicle that is already in the intersection. When two vehicles arrive at about the same time from different roads, section 304.351, RSMo, requires the driver on the left to yield to the driver on the right. Roundabouts are the exception: there, you yield to traffic already in the circle. The law says who must yield but never guarantees you the right-of-way, so be ready to stop.
