Hawaii Provisional License Rules: Passengers, Curfew, Work
What are the Hawaii provisional license passenger and curfew rules?
A Hawaii provisional driver may carry only one person under 18, unless a licensed parent or guardian rides along or the person is a household member. From 11:00 p.m. to 5:00 a.m. the driver needs a licensed parent or guardian in the front passenger seat. The only other night trips allowed are necessary drives to or from work or a school-authorized activity, with a signed statement.
Where these rules come from
The passenger, night and penalty rules come from the City and County of Honolulu graduated driver licensing page. The 2023 Hawaii Driver's Manual from the Hawaii Department of Transportation gives the same rules in short form. The fees come from the Honolulu license requirements page, and the steps to convert come from the Honolulu driver's license procedures page. Driver licensing in Hawaii is run by each county, and these pages are for Honolulu (Oahu). If you live on another island, ask your county office whether its steps and fees are the same. This guide is current as of 2026. Confirm the rules with your county driver licensing office or the Hawaii Department of Transportation (hidot.hawaii.gov) before you drive.

How the passenger limit works
The provisional license is Phase Two of Hawaii's graduated licensing program for drivers under 18. The Honolulu page says you may not carry more than one person under 18 without a licensed parent or guardian in the car, unless that person is a household member.
The Driver's Manual says it more briefly: only one person under 18 who is not a household member. If you are not sure whether a passenger, such as a cousin who stays with you, is a household member, ask your county office.
The limit counts passengers under 18 only and also applies at night. Check it with the free question on the provisional passenger limit.
The 11 p.m. to 5 a.m. curfew
A provisional driver may not drive from 11:00 p.m. to 5:00 a.m. unless a parent or guardian sits in the passenger seat beside the driver. That parent or guardian must be licensed to drive the same type of vehicle. A parent in the back seat does not meet the rule. The only other night trips allowed are the work and school trips below.
The instruction permit has a similar night rule: from 11:00 p.m. to 5:00 a.m., the supervising parent or guardian must sit next to the permit driver. The instruction permit supervisor rules cover that stage. Practice the provisional rule with the free question on the provisional night restriction.
The work and school exceptions
Penalties and other rules to know
For a first violation of the provisional rules, the Honolulu page says the license is suspended for three months. For a second or later violation, the license is revoked for six months. The guide to provisional license suspension and zero tolerance covers these penalties and traffic convictions in more detail.
Two more rules matter on every trip. All occupants must wear seat belts, and children under 4 must ride in a child safety seat. Also, drivers under 21 may not drive with a blood alcohol content of .02 or more.
From instruction permit to full license in Hawaii
- 1
Qualify for the provisional license
Be at least 16 and under 18. Hold your instruction permit for at least 180 days with no pending violation that might lead to a suspension or revocation. Have your driver education classroom and behind-the-wheel certificates.
- 2
Pass the road test and pay
Pass a road test at a Driver Licensing Center. On Oahu, the road test costs $8 (U.S. dollars) and the provisional license costs $5 per year or part of a year.
- 3
Drive under the provisional rules
Keep the passenger and night limits while you hold the provisional license, and carry the license every time you drive. You need at least six months on it before the full license.
- 4
Convert to the full license
At 17 or older, with six months on the provisional license, make an AlohaQ appointment on Oahu. Bring your provisional license and any documents you have not shown before, pass the eye test and pay $20 for a four-year license (ages 17 to 24).
- 5
Convert before your 19th birthday
The provisional license expires on your 19th birthday. After that you must apply again as an adult. If the expiry date falls on a weekend or holiday, convert by the last working day before it.

Hawaii provisional license: common questions
Can I drive two friends under 18 on a provisional license?
Not on your own. You may carry one friend under 18. A second passenger under 18 may ride only when a licensed parent or guardian rides along, or when that passenger is a household member. If you are not sure who counts as a household member, ask your county office before the trip.
Can I drive home from work after 11 p.m.?
Yes, if you must drive to make that trip. Keep a signed statement from your employer with you. It gives the employer's name, address and telephone number, and it confirms your job and your work hours. Without that statement, the curfew applies. The passenger limit also stays: no more than one person under 18 without your licensed parent or guardian.
Can an adult who is not my parent ride with me after 11 p.m.?
Not to meet the night rule. From 11:00 p.m. to 5:00 a.m., the person beside you must be your parent or guardian, licensed to drive the same type of vehicle. Another licensed adult does not meet the rule. Without a parent or guardian, you may drive at night only for a necessary work or school-authorized activity trip.
Do I need a statement to drive to a school event at night?
Yes. The statement comes from your parent or guardian. It gives the parent's or guardian's name, address and telephone number, and it confirms that you must drive to or from the school-authorized activity. Keep it with you on the trip, together with your provisional license.
Can a traffic ticket cost me my provisional license?
Yes, if it leads to a conviction. If you are convicted of an offense related to driving a motor vehicle, a first conviction brings a six-month suspension or revocation of the provisional license. Also, while a violation is still pending, you cannot get the full license.
Is the curfew the same on every island?
Yes for the rule itself. The statewide Hawaii Driver's Manual gives the same 11:00 p.m. to 5:00 a.m. limit, the same one-passenger limit and the same work and school exceptions. The signed-statement details and the fees in this guide come from Honolulu (Oahu) pages. On another island, ask your county office about its fees and steps.
