Indiana School Bus Stop Arm Law: When You Must Stop and the Penalties
When must you stop for a school bus in Indiana?
In Indiana, you must stop for a school bus with its red lights flashing and its stop arm extended, whether you meet it from the front or come up behind it. On a highway divided by a barrier or an unimproved median, only traffic going the same direction as the bus must stop. Stay stopped until the red lights stop, the arm is withdrawn and the bus moves.
Where the Indiana school bus rules come from
The rules come from the Indiana Department of Education (IDOE) copy of the school bus sections of the Indiana Code (IC 9-21-12 and IC 9-21-8-52, as of July 1, 2022), the Indiana Driver's Manual (July 2026), the Indiana Criminal Justice Institute school bus safety page, its 2024 stop arm fact sheet and the BMV driving skills test page. The law text is the 2022 IDOE copy, so a later change to the law is not in it. This guide is current as of 2026. Confirm the rules with the Indiana Bureau of Motor Vehicles (in.gov/bmv) before you drive.
What do the school bus lights and the stop arm mean?
A school bus in Indiana has amber and red flashing lights. The amber lights come on first and warn that the bus is slowing down to load or unload children. When the bus stops, the red lights and the stop arm come on, which means that children are getting on or off.
The bus driver must extend the arm when the bus stops on a roadway or a private road to load or unload a student, and the arm stays out while the bus is stopped. The law does not require the arm at an intersection or another place where a traffic control device or a police officer controls traffic.

Which roads count as a divided highway in Indiana?
The law names three kinds of division between two roadways: an unimproved space that is not for vehicle travel, a physical barrier, and a dividing section built to impede traffic. Examples of a barrier are a cable barrier, a concrete wall and a grassy median. When the bus is on the other side of one of these, you do not have to stop, but you must drive on with care for children.
An easy rule to remember: unless a barrier separates you from the bus, you must obey the stop arm. The practice question on a school bus on the opposite roadway of a divided highway tests this rule.
What to do when you see a school bus in Indiana
- 1Slow down at yellow lights
Amber flashing lights warn that the bus will stop soon. Slow down and prepare to stop. The practice question on amber school bus lights tests this.
- 2Stop when the red lights and the stop arm come on
Stop before you reach the bus. Check whether a barrier or an unimproved median separates you from the bus.
- 3Stay stopped until the bus moves
Wait until the red lights stop flashing, the stop arm is withdrawn and the bus begins to move. If you go on before the arm is no longer extended, you break the law too. The practice question on red school bus signals tests this.
- 4Watch for children when you drive on
Children play or gather near bus stops, and a child who is late for the bus may dart into the street without looking. The biggest risk to children is the time when they walk to or from the bus, not the ride.
Indiana penalties for passing a stopped school bus (law as of July 1, 2022)
| What you do | What the law says |
|---|---|
| You meet or overtake a stopped bus with the arm extended and do not stop, or you go on before the arm is no longer extended | Class A infraction. The court may also suspend your driving privileges for 90 days, or for one year after an earlier offense. |
| You recklessly pass a stopped bus with the arm extended | Class A misdemeanor. The court may also suspend your driving privileges for 90 days, or for one year after an earlier offense. |
| Reckless passing that causes bodily injury | Level 6 felony |
| Reckless passing that causes death | Level 5 felony |
Can the car owner be charged, and does it affect the driving test?
Under the infraction law, there is a rebuttable presumption that the owner of the vehicle committed the violation. This presumption does not apply to an owner who routinely rents out the vehicle for periods of 30 days or less.
A stop arm mistake also ends a driving test. On the BMV driving skills test, passing a school bus with its arm out, or failing to stop for a school bus, is an automatic failure. Our guide to the Indiana driving test lists the other automatic failures.
How do Indiana police find stop arm violators?
Indiana's Stop Arm Violation Enforcement (SAVE) program started in 2019. It gives grants to law enforcement agencies for high visibility patrols that target stop arm violations, speeding and reckless driving around school buses and school zones. Follow-up investigations can use footage from dash cameras on school buses. In 2023, 2,091 stop arm violations were observed in one day in Indiana, according to Indiana Department of Education data.
Key takeaways
- Stop for a school bus with red flashing lights and the stop arm extended, from any direction, unless a barrier or an unimproved median divides the road between you and the bus.
- Traffic that goes in the same direction as the bus always stops.
- Yellow lights mean slow down and prepare to stop.
- Passing a stopped bus is a Class A infraction with a possible suspension. Reckless passing is a Class A misdemeanor, or a felony if it causes injury or death.

Indiana school bus law: common questions
Do I have to stop for a school bus with yellow lights?
Slow down and prepare to stop. Yellow (amber) flashing lights mean that the bus is preparing to stop to load or unload children. When the bus stops, the red lights and the stop arm come on, and from that moment you must stop.
How long do I have to wait at a stopped school bus?
Wait until the red lights stop flashing, the stop arm is withdrawn and the bus begins to move. Going on while the arm is still out is a Class A infraction in Indiana. When you drive on, watch for children, because a child who is late for the bus may dart into the street.
Can I lose my license for passing a school bus in Indiana?
Yes. The court may suspend your driving privileges for 90 days, or for one year if you have an earlier school bus offense. This possible suspension applies to the Class A infraction and to reckless passing, which is a Class A misdemeanor. These rules come from the law text as of July 1, 2022.
Do I have to stop for a school bus on a four-lane road?
Yes, when nothing divides the road. The rule applies on all roads and from any direction, with one exception: a highway divided by an unimproved space, a physical barrier or a dividing section built to impede traffic. A four-lane road with no such division is not the exception, so traffic in both directions stops.
Does the stop arm law apply to a school bus on a private road?
Yes. The Indiana law covers a school bus stopped on a roadway or a private road, and both the Class A infraction and the reckless passing offense name private roads. The bus driver must extend the stop arm on a private road too when the bus loads or unloads a student.
