Kansas School Bus Law: When You Must Stop and the Fines

informational·how to guide·

Where the Kansas school bus facts come from

The stop rule comes from Kansas law (K.S.A. 8-1556), the bus lights from K.S.A. 8-1730, and the fines from the uniform fine schedule in K.S.A. 8-2118, as amended by 2026 Senate Bill 366. The road examples come from the Kansas Driving Handbook (revised February 2022). This guide is current as of 2026. Confirm the rules with the Kansas Department of Revenue, Division of Vehicles (ksrevenue.gov) before you drive.

The basic Kansas rule: stop before you reach the bus

The duty to stop starts when a school bus is stopped on the road and its flashing red lights are on. It applies to every driver who meets the bus (comes toward it) or overtakes it (comes up behind it). You must stop before you reach the bus.
A school bus driver may turn on the red lights only when the bus is stopped to pick up or let off school children. So flashing red lights tell you that children may be getting on or off the bus.

Yellow flashing lights on a Kansas school bus

Some school buses also have yellow flashing lights next to the red ones. These lights are optional. When a bus has them, the bus driver turns them on 200 to 1,000 feet before each stop where the red lights will flash. So yellow lights warn you that the bus will soon stop and turn on its red lights.

What to do when a school bus stops ahead

  1. 1
Stop before you reach the bus

When the red lights flash, stop your vehicle before you reach the bus. This applies when you drive behind the bus and when you drive toward it.

  2. 2
Stay stopped while the red lights flash

Do not pass the bus in any lane while its red lights flash. The bus is stopped to pick up or let off children.

  3. 3
Wait for the bus to move or the signals to go off

You may go when the bus moves again, or when its flashing red lights and stop arm are off.

  4. 4
Watch for children before you go

Look for children along the side of the road. Do not go until it is safe and they have completely left the roadway.

Divided highways: when you do not stop in Kansas

Kansas law gives one main exception. On a highway with separate roadways, you need not stop for a school bus on a different roadway. In practice, this is a bus that comes toward you on the other side of a median or other physical barrier.
Painted lines do not count as a barrier. With two solid yellow lines or a center turning lane between you and the bus, you stop from both directions. The free Kansas practice question about a bus on the opposite side of a divided roadway uses the median case.

How the Kansas school bus fines add up

The amounts above are on the statewide uniform fine schedule in K.S.A. 8-2118. The 2026 changes to that law took effect on July 1, 2026, and kept all four amounts. The higher fines count only earlier convictions for passing a school bus within five years.
If you pay the ticket before your court date, you pay the schedule fine plus court costs. If you go to court instead, the schedule does not limit the fine that the court may set.

Key takeaways

  • Stop before you reach a school bus with flashing red lights, whether you come from behind it or toward it. Yellow flashing lights warn that such a stop is coming.
  • Go when the bus moves again, or when the red lights and stop arm are off, and only after children have left the road.
  • You do not stop for a bus on the other side of a median or other physical barrier. Painted lines and turning lanes do not count.
  • The fine is $315. It is $750 for a second violation within five years and $1,000 for a third.

Kansas school bus law: common questions

Do you have to stop for a school bus on a four-lane road in Kansas?

Yes, if no median or physical barrier separates you from the bus. A multi-lane highway is a place where you stop, whether the bus is on your side of the road or on the opposite side. A painted center line or a center turning lane does not change that.

Do you have to stop for a church bus or a day care bus in Kansas?

Yes. The Kansas Driving Handbook says that you must stop when you meet or overtake a school bus, church bus or day care bus that is stopped to pick up or let off children. Kansas has a separate fine for improper passing of a church or day-care bus: $195 on the uniform fine schedule.

Do you have to stop for a city bus in Kansas?

No, not as you do for a school bus. You do not have to stop for a transit bus that picks up or drops off people, unless you are behind it. Still, watch for passengers near the bus: a stopped bus can block your view of people who are about to cross the street.

Can you just pay a school bus ticket in Kansas?

Yes. Before the court date on the ticket, you may plead guilty or no contest in writing and pay. You then pay the fine on the uniform fine schedule, $315 for a first violation, plus court costs. The fine is higher if you have earlier convictions for passing a school bus within five years.

Is the school bus rule on the Kansas written test?

It can be. The Kansas Driving Handbook puts the school bus stop rule in its practice questions and says that these questions may be on the test. Study the handbook rules on stopping, then try the free question on stopping for a school bus. The Kansas permit test guide explains the rest of the test.
