Montana School Bus Stop Law: When to Stop and the $500 Minimum Fine

informational·how to guide·

Where the Montana school bus facts come from

The stopping rules, the stop arm rules and the penalties come from Montana Code Annotated 61-8-351, the state law on school buses. The driving advice comes from the Montana Driver Manual of the Motor Vehicle Division. This guide is current as of 2026. Confirm the rules with the Montana Motor Vehicle Division (mvdmt.gov) before you drive.

What do the amber lights on a Montana school bus mean?

Amber lights warn you that the bus will stop soon. Bus drivers turn them on about 150 feet before a stop in cities and about 500 feet before a stop in other areas. Slow down and drive carefully, because children may be in the road. Then be ready to stop when the red lights come on. Can you pass a stopped school bus on the right in Montana?

No. A driver may not overtake a stopped school bus on its right side. This is a separate offense from not stopping for the red lights. It is a misdemeanor, and the penalty is a fine of up to $1,000, up to 6 months in jail, or both.

How does the school bus stop arm work?

A bus that serves a stop where a child must cross the road must have an extended stop arm. The arm partly blocks the roadway, and children may not cross to or from the bus unless the arm is out. The arm has its own flashing red lights. It must be able to extend at least 54 inches from the bus, at a height of at least 36 inches. Each school bus also shows "SCHOOL BUS" signs on the front and rear, with letters at least 8 inches high.

Montana school bus law: common questions

Do you have to stop for a school bus with no flashing lights in Montana?

The stop rule applies when a stopped bus flashes its red lights. Bus drivers use red lights only when the bus is stopped on the highway or street to load or unload children. A bus stopped off the roadway and paved shoulder may not use them while the children stay off the road. A school board may also bar the lights at a school-site stop where children do not cross a street.

Do I stop for a school bus on a divided highway in Montana?

Not when the bus is on a different roadway of a highway with separate roadways. The same is true on a controlled-access highway when the bus is in a loading zone where pedestrians may not cross. On a two-lane road with no median, a bus in the opposite lane with red lights flashing means you must stop.

Is passing a school bus a misdemeanor in Montana?

Yes. Three school bus offenses are misdemeanors in Montana: not stopping for the red lights, passing a stopped bus on the right, and contact with a bus at a stop-arm stop. For not stopping, a first offense brings a fine of $500 to $1,000, 50 to 100 hours of community service, or both. A third offense can bring at least 30 days in jail.

Can I drive past a school bus when the children have crossed the road?

No. Montana law says you may not go past the bus until it stops flashing its red lights. The lights tell you when to go, not the children and not the movement of the bus. Stay stopped no closer than about 30 feet from the bus until the red lights go off, then drive on carefully.

What happens if I hit the stop arm of a school bus in Montana?

Contact with any part of a school bus stopped with its stop arm, including the stop arm or a school child within 30 feet of the bus, is a misdemeanor. It carries the same penalties as not stopping for the red lights: for a first offense, a fine of $500 to $1,000, 50 to 100 hours of community service, or both.
