NC Provisional License Suspension, Points and Cell Phone Law
What happens if a provisional driver gets a ticket in North Carolina?
In North Carolina, a provisional license may be suspended for 30 days after a second moving violation conviction within 12 months, 90 days after a third and six months after a fourth, says the 2026 Driver Handbook. The steps count convictions, not tickets. A moving violation, seat belt or phone conviction in the last six months also holds a teen back from Level 2 or Level 3.
Where these rules come from
This guide uses the 2026 North Carolina Driver Handbook, the NCDMV license suspension page and the NCDOT driving laws page, as of 2026. The NCDMV Level 2 page gives the same six-month rule as the handbook. All amounts are in U.S. dollars. Confirm the rules with the North Carolina DMV (ncdot.gov/dmv) before you drive.
Does a ticket suspend a provisional license in North Carolina?
Not by itself. Each provisional suspension step starts with a conviction for a moving violation. Every driver under 18 is a provisional licensee. Some moving violations are speeding, reckless driving, passing a stopped school bus and running a stop sign or red light. The DMV also reviews the record of a driver under 18 more closely and may contact the driver after some convictions or crashes. A high-speed conviction brings its own suspension, as the speeding rules below show.
Provisional license suspension steps in North Carolina
| Moving violation convictions within 12 months | The license may be suspended for |
|---|---|
| Second conviction | 30 days |
| Third conviction | 90 days |
| Fourth conviction | Six months |
How a conviction delays Level 2 or Level 3
Before a teen moves from Level 1 to Level 2, or from Level 2 to Level 3, the record must show six months with no convictions for moving violations, seat belt infractions or cell phone infractions. So one conviction can push the next level back until the record has six clean months. The $25 phone ticket for drivers under 18 counts here too, because it is a cell phone infraction. The guide to the Level 2 limited provisional license lists the other Level 2 steps.

How driver license points work in North Carolina
After a conviction for some violations, the DMV puts driver license points on your record. Insurance companies use a different point system to set insurance rates, so the two kinds of points are separate. The table shows the point limits and the length of a point suspension. The free question on how many points can lead to a first suspension tests the 12-point rule.
Driver license point limits in North Carolina
| Points | What can happen |
|---|---|
| 7 points | The DMV may assign you to a driver improvement clinic, or you can ask for one. You can take a clinic once every five years, and three points come off when you finish. |
| 12 points within three years | Your license may be suspended: 60 days for the first point suspension, 6 months for the second and 12 months for the third. |
| 8 points within three years after reinstatement | A second suspension can follow. |
What is the cell phone rule for drivers under 18 in North Carolina?
A driver under 18 may not use a cell phone, or other technology that goes with a cell phone, while driving on a public street, highway or public vehicular area. The rule also applies on a Level 3 full provisional license until age 18. The handbook allows a call about an emergency to an emergency response operator, a hospital, doctor's office or health clinic, an ambulance service, a fire department, a law enforcement agency, or your parent, legal guardian or spouse. The NCDOT page words the exceptions as emergencies or talking to a parent or spouse. The question on phone use for a driver under 18 tests this rule.
Phone and texting fines in North Carolina
| Violation | Penalty |
|---|---|
| Driver under 18 uses a mobile phone or related technology while driving | A $25 fine, with no driver license points, no insurance surcharge and no court costs |
| Any driver reads or writes a text message or email while the vehicle is moving | A $100 fine and court costs |
What happens to a driver under 21 who drives after drinking?
A driver under 21 who is convicted of driving with any amount of alcohol or drugs in the body loses the license for one year. A provisional licensee gets the same one-year revocation after a conviction for driving after or while consuming any amount of alcohol or drugs. The legal age to buy alcohol in North Carolina is 21. A conviction for buying, or trying to buy, alcohol under that age also brings a one-year revocation. The question on driving with a small amount of alcohol under 21 tests this rule.
How to get a suspended license back in North Carolina
- Pay the restoration fee before the DMV can clear the suspension or revocation: $83.50, or $167.25 when the revocation comes from a DWI conviction.
- Pay the $50 service fee too, unless you surrendered the license to the court or mailed it to the DMV before the suspension or revocation started.
- When the DMV reinstates your driving privilege, all earlier driver license points are canceled. This does not apply to insurance points.
Key takeaways

NC provisional license penalties: common questions
Does a speeding ticket suspend my license at 16?
The ticket alone does not, but a conviction can. Going more than 15 mph over the limit at a speed above 55 mph, above 75 mph where the limit is under 70 mph, or above 80 mph brings a suspension of at least 30 days. Speeding is also a moving violation, so a second conviction in 12 months can bring the 30-day provisional suspension.
Can I call my parent while I drive if I am under 18?
Yes, about an emergency. The handbook allows a driver under 18 to call a parent, legal guardian or spouse about an emergency, and the NCDOT driving laws page lists talking to a parent or spouse as an exception. Other phone use while you drive can bring a $25 fine and can hold back your next license level.
What happens if I miss my court date for a ticket?
NCDMV suspends your driving privileges, with no end date, until you comply with the case. The same applies when you do not pay the fine. First contact the court in the county where you got the citation. When the case is complete, contact NCDMV to find out if you can reinstate your license.
Does a seat belt ticket delay my Level 2 license?
A seat belt conviction can. To move from Level 1 to Level 2, the record must show no convictions for moving violations, seat belt infractions or cell phone infractions in the last six months. The same clean six months apply before Level 3. So you wait until the conviction is more than six months old.
Can a driver improvement clinic take points off my record?
Yes. At 7 points, the DMV may assign you to a driver improvement clinic, or you can ask for one. When you finish the clinic, three points come off your driving record. You can take a clinic once every five years.
