NY Green Light Law: Driver's License Without a Social Security Number

informational·how to guide·

Where this information comes from

The facts here come from the New York State DMV page on driver licenses and the Green Light Law, the DMV ID-44 form, How to Apply for a Driver License, Learner Permit or Non-Driver ID (revised 2/26) and the DMV fees, refunds and payment methods page. The REAL ID facts come from the DMV Enhanced or REAL ID page. This guide is current as of 2026. Confirm the rules with the New York State DMV (dmv.ny.gov) before you drive.

What the Green Light Law covers and who can apply

  • Who: all New Yorkers age 16 and older, regardless of citizenship or lawful status in the United States.
  • What you can apply for: a standard, not-for-federal-purpose, non-commercial driver license or learner permit.
  • What it does not cover: Non-Driver ID cards and commercial licenses (CDL).

What if I have no Social Security number?

You do not need a Social Security card to apply for a license or permit, and applicants who were never issued a Social Security number can apply.
When you apply for a standard driver license, you sign an affidavit (a sworn statement) that you were never issued a Social Security number. On the DMV form ID-44, this affidavit (form NSS-1 or NSS-1A) is one of the Social Security items, and each applicant gives one item from that list. You cannot use the affidavit for an Enhanced or REAL ID credential.

How to get a standard New York license without a Social Security number

  1. 1
    Check your age and consent

You must be at least 16 and live in New York State. At 16 or 17, you need parental consent, unless you are 17 and have a Driver Education Certificate of Completion (MV-285).

  2. 2
    Collect your proof documents

Bring original documents, or documents certified by the agency that issued them, that prove your name, date of birth and New York State residency. ID-44 lists the accepted proofs and their point values.

  3. 3
Fill in form MV-44 and sign the affidavit

Complete the Application for Permit, Driver License or Non-Driver ID Card (MV-44). Sign the affidavit of never having been issued a Social Security number (NSS-1 or NSS-1A).

  4. 4
Pass the written test and the vision test

You must pass a written (knowledge) test and a vision test to get a learner permit.

  5. 5
    Pay the fees

The total depends on your age and county. See the fee table below.

  6. 6
    Pass the road test

After you get the learner permit, you must pass a road test before you can get a driver license. Before your first drive on the permit, check who may supervise you on a learner permit.

Which documents does DMV accept? The ID-44 rules

Which documents does DMV accept? The ID-44 rules
RuleWhat ID-44 and the DMV page say
Three things to proveName, date of birth and New York State residency, shown with a combination of documents
Name pointsEach document has a point value, and your proof of name points must total at least 6

Residency1 proof of residency for a standard license or permit (2 for Enhanced or REAL ID)
Address on the documentYour current address, pre-printed. A P.O. box is not accepted
DuplicatesOnly one document of each proof type
Foreign passportProof of lawful status when you also bring the extra papers on ID-44 page 3. Without them, it counts as proof of date of birth only
Other foreign documentsA foreign birth certificate, a foreign driver license with photo (current, or expired no longer than 2 years), a foreign national ID card with photo and a consular ID count as proof of date of birth only

Foreign-language, expired and electronic documents

A document in a foreign language must come with a certified English translation. DMV does not accept expired documents unless the ID-44 list allows it, as it does for a foreign driver license. Print electronic statements and e-bills before your visit. The guide to New York DMV documents and the 6 points of ID has the full lists and point values.

That fee is $1.00 for every 6 months the permit or license is in effect. The MCTD counties are Bronx, Kings (Brooklyn), New York (Manhattan), Queens, Richmond (Staten Island), Dutchess, Nassau, Orange, Putnam, Rockland, Suffolk and Westchester. The guide to New York permit and license fees gives the total for each half year of age.

What a standard Green Light license can and cannot do

You want to board a domestic flight or enter some secure federal buildings
A standard license without proof of a Social Security number, an SSA ineligibility letter or proof of lawful status does not comply with the federal REAL ID Act, so you cannot use it for these. They need a REAL ID, unless you have a valid passport.
You only want to drive
A REAL ID is optional and is not needed to be licensed to drive.
You want an Enhanced license
A New York Enhanced license is for U.S. citizens who live in New York State.
You want to register to vote or become a citizen
The law does not change your eligibility to register to vote. Only U.S. citizens can register. It also gives no pathway to citizenship.

Privacy of your DMV records and language help

The law has privacy protections that limit data sharing, including with agencies that mainly enforce immigration laws. It also requires DMV to tell license holders when an immigration enforcement agency asks DMV for their data.
All DMV offices give language access help to people with limited English proficiency.

Key takeaways

  • New Yorkers age 16 and older can apply for a standard, non-commercial license or learner permit, whatever their citizenship or lawful status.
  • No Social Security card is needed: you sign an affidavit of never having been issued a Social Security number.
  • Prove your name, date of birth and New York residency, with at least 6 points of proof of name and 1 proof of residency.
  • The license is marked NOT FOR FEDERAL PURPOSES, so you cannot use it to board a domestic flight.
  • Next step: practice on the free New York Class D permit practice test, which is in English only.

Green Light Law: common questions

What if I have a Social Security number but lost the card?

ID-44 lists another Social Security item: your Social Security number without the card. You print the number on the application form, MV-44. The affidavit (NSS-1 or NSS-1A) is only for applicants who were never issued a Social Security number. Each applicant gives one Social Security item.

Will my Green Light license look different from other licenses?

No. All standard New York State driver licenses look the same, whatever proof documents you gave when you applied. Every standard license carries the words NOT FOR FEDERAL PURPOSES, so the license does not show which documents you used.

Can I renew my license online if I have no Social Security number?

No. If you got your license without proof of a Social Security number, you renew or replace it by mail or in person at a DMV office. DMV online services need a Social Security number on file for the user.

Can I pay the DMV fees in cash?

Yes, at a DMV office. There you can also pay with a personal check or money order payable to the Commissioner of Motor Vehicles, or with most credit, debit and prepaid cards that need no PIN. You can split a payment between cash and check. Do not send cash by mail.

Who can help me with an immigration problem at a DMV office?

Call the New York State Office of New Americans hotline at 1-800-566-7636. It is toll-free and helps DMV customers with immigration-related issues or discrimination at a DMV office. Calls are confidential and anonymous, live help is in more than 200 languages, and anyone can call.
