Full License at 17 in Rhode Island: Leaving the Provisional License
When can you get a full driver's license at 17 in Rhode Island, and do you take another test?
You can apply for a full operator's license when you are at least 17 and under 18, have held the limited provisional license for at least 12 months, and have had no moving violation or seat belt conviction in the past 6 months. The road test is a Level 2 step, and the law lets you obtain the full license by mail.
Where the Rhode Island full license rules come from
Rhode Island sets the three license levels and the Level 3 rules in R.I. Gen. Laws § 31-10-6. The first-license year and the traffic tribunal hearing are in § 31-10-26, and the parent signature rule is in § 31-10-14. The license term comes from § 31-10-30, the fees from §§ 31-10-6.3 and 31-10-31, the penalties from § 31-10-6.4, the supervising driver rule from § 31-10-6.1 and the under-18 phone ban from § 31-22-11.9. The Division of Motor Vehicles rule 280-RICR-30-00-1 repeats the hearing rule. This guide is current as of 2026. Confirm the rules with the Rhode Island Division of Motor Vehicles (dmv.ri.gov) before you drive.
Level 3 is the last step of three
Rhode Island gives drivers under 18 three levels of driving privilege: Level 1, the limited instruction permit; Level 2, the limited provisional license; and Level 3, the full operator's license. Each permit or license has a color background or border that shows its level. This guide covers the move from Level 2 to Level 3. A teen who still needs the first steps can start with the guide to the Rhode Island limited instruction permit at 16.
Do you meet the three rules for the full license?
Why most teens are closer to 17 and a half
The limited instruction permit starts at 16 at the earliest. The law requires at least 6 months on the permit before the provisional license and 12 months on the provisional license before the full license. A teen who gets each license on the first possible day reaches Level 3 at about 17 years 6 months. A permit at 16 years 4 months, for example, moves the earliest full license to about 17 years 10 months.
Is there a road test for the full license?
No new road test is part of the Level 3 rules: the road test is a condition of Level 2, the provisional license. For Level 3, the law asks for your age, 12 months on the provisional license and 6 clean months. A person who meets these rules may obtain the full operator's license by mail. The law says you "may apply for and obtain" the license, so plan to send an application, signed by a parent or guardian.
Level 2 limits that do not apply at Level 3
| Limit | Provisional license (Level 2) | Full license (Level 3) |
|---|---|---|
| Driving alone | Alone from 5:00 a.m. to 1:00 a.m., on trips to or from work, and on a few other trips that the law lists. | No time-of-driving limit. |
| Supervising driver | A supervising driver must sit beside you outside those times. That driver must have been licensed for five years. | No supervision limit. |
| Passengers | In the first 12 months, no more than one passenger younger than 21. Immediate family and household members are excepted. | No passenger limit. |
| Penalty for breaking a limit | Breaking the time or supervisor limit is driving without a license. Other limits are infractions with fines of $100, $110 and $140 (U.S. dollars). | No provisional limits, so no provisional penalty. |
Why the Level 2 limits still matter until you switch
The Level 2 limits stay in force until you hold the full license. A 17-year-old with 8 months on the provisional license who drives home alone at 1:30 a.m., not from work or another listed trip, breaks the time limit, and the law treats that as driving without a license. The guide to the provisional license curfew and passenger limit has all the hours and exceptions. The late-night limit practice question tests the same case.
What is the "first license" year and the traffic tribunal hearing?
Rhode Island law calls the license of a person who applies for the first time a "first license." It is issued for a one-year period, after which a permanent license is issued. If the holder has one adjudicated moving violation, one reportable crash, or both during the first-license period, a traffic tribunal judge holds a hearing and reviews the driving record. The judge decides whether to grant the license, reissue a first license, or deny a license. Ask the Rhode Island Division of Motor Vehicles if your full operator's license counts as a first license.
How long does the full license last?
A full operator's license is issued and expires as § 31-10-30 sets. Under that section, a first license is a temporary license that expires on your birthday in the second year after it is issued. A license issued after that expires on your birthday in the fifth year after issue. Ask the Division of Motor Vehicles which term applies to your license.
Fees the law sets for the full license
- The fee for a full operator's license is the amount in § 31-10-31.
- That section sets $25 (U.S. dollars) for an operator's first license and $5 for a first license examination.
- Each renewal of an operator's license costs $30.
- A duplicate license or a name or address change costs $25.
- Ask the Rhode Island Division of Motor Vehicles which fee applies to your full license, and check the current fee before you pay.
How to get ready for the full license
- 1Count your months
Write down the date of your provisional license. Add 12 months. Check that the date falls before your 18th birthday.
- 2Keep your record clean
Avoid a moving violation or seat belt conviction. You need 6 months without one before you apply.
- 3Keep to the Level 2 hours until the new license arrives
Drive alone only from 5:00 a.m. to 1:00 a.m. or on a trip the law lists. Outside those times, a supervising driver must sit beside you.
- 4Have a parent or guardian sign your application
Under 18, your application for the full license must be signed and verified before a person authorized to give oaths.
- 5Ask the Division of Motor Vehicles for the current form
The law lets you obtain the full license by mail.
- 6Practice the rules
The practice question on moving from the provisional to the full license checks the 12-month rule.
Key takeaways
- You may apply for the full operator's license at 17 or older and under 18, after 12 months on the provisional license and 6 months with no moving violation or seat belt conviction.
- No new road test is part of Level 3. The law lets you obtain the license by mail, with an application signed by a parent or guardian.
- The time, supervision and passenger limits of Level 1 and Level 2 do not apply to the full license.
- A first-license holder with one moving violation or reportable crash gets a traffic tribunal hearing on the driving record. Ask the Division of Motor Vehicles if your full license counts as a first license.

Rhode Island full license: common questions
Do my parents have to sign for my full license?
Yes, if you are under 18. Rhode Island law says your application for a full operator's license must be signed and verified before a person authorized to give oaths. The signer is a parent, guardian, adult spouse or licensed foster parent who lives in Rhode Island and can be a supervising driver. If there is no such person, another responsible adult can sign.
Can I drive my friends around once I have the full license?
Yes. The provisional passenger limit of one passenger under 21 applies only in the first 12 months of the provisional license, so it has already ended when you qualify for the full license. The full license also ends the time-of-driving and supervision limits of Level 1 and Level 2.
Can I use my phone while driving with a full license at 17?
No. Rhode Island law bans the use of a personal wireless communication device by any driver under 18, except in an emergency, whatever the license level. The fine is $100 for a first conviction and $150 for a second. A third conviction brings a $250 fine and/or loss of the license until your 18th birthday.
Do I need a new license when I turn 21?
Only if you want one. A Rhode Island license for a person under 21 must be clearly different in color from licenses for people 21 and older. When you turn 21 with a valid license, you may ask the Division of Motor Vehicles for a new over-21 license at no cost.
