South Carolina School Bus Stop Law: When to Stop and the $500 Minimum Fine

informational·how to guide·

Where the South Carolina school bus facts come from

The stop rules, the multi-lane exception, the camera rules and the penalties come from the South Carolina Code of Laws, Title 56, Chapter 5, sections 56-5-2770 to 56-5-2780. The advice to stop the whole time and to go on slowly comes from the SCDMV Driver's Manual, Section 7. The point value comes from section 56-1-720 of the Code, and the other point rules come from section 56-1-185 and the SCDMV points system page. This guide is current as of 2026. Confirm the rules with the SCDMV (scdmvonline.com) before you drive.

Do you stop for a school bus? Check your road and your direction

You are on a two-lane road, coming toward the bus or behind it
Stop before you reach the bus when its flashing red lights are on. The stop rule applies from either direction.
You are behind the bus on a road with four or more lanes
Stop, in any lane. The multi-lane exception covers only drivers who meet the bus from the opposite direction.
You meet the bus from the opposite direction on a road with four or more lanes
You need not stop. By law, a multi-lane road has four or more traffic lanes, with at least two lanes in each direction.
The bus has its amber signals on
Do not pass it. The law bans passing a school bus that has its amber signals on, even before the red lights come on.

Do you stop for a school bus on a four-lane road in South Carolina?

On a road with two lanes each way, your direction decides. By law, bus routes along these roads must be planned so that no student has to cross the road.
Take a four-lane road with no median. A bus ahead of you stops in the right lane with its red lights flashing, and you are in the left lane behind it: you stop. Try our free question on stopping behind a bus on a four-lane highway. If the bus stops in the lanes going the other way, you continue with care. Check it with our free question on a bus in the opposing lanes.

What to do when a school bus stops

  1. 1
    Watch for amber lights

Bus drivers turn on the amber and red signals when the bus is stopped or getting ready to stop to load or unload children. Be ready to stop, and do not pass.

  2. 2
Stop before you reach the bus

Stop when the flashing red lights come on. Do not drive up to the bus or go around it.

  3. 3
    Stay stopped

Do not move until the bus drives on or the flashing red lights go off, even when the children are already off the road.

  4. 4
    Go on slowly

When the lights are off and the stop arm is no longer out, drive on slowly and watch for children.

Can a school bus camera give you a ticket?

Yes, camera images can support a ticket. A school bus may carry a digital video device with a clear view of vehicles that pass on either side. The video shows the date and time and whether the amber lights, flashing red lights, stop arm and brakes were on. A ticket may be based in whole or in part on those images, but the officer who writes it must give it directly to the driver. At a hearing, the images may back up the bus driver or another witness.

When does passing a school bus become a felony?

The same penalties apply when you break the red-light stop rule and when you pass a bus that has its amber signals on. A first or second offense is a misdemeanor, and a first offense may be tried in magistrate's court.
The offense becomes a felony when it causes great bodily injury or death to a pedestrian. Great bodily injury is an injury that creates a substantial risk of death, or that causes serious, permanent disfigurement or a long loss of use of a body part or organ. After a felony conviction, the SCDMV suspends the license for the prison term plus one year.

How many points is passing a school bus in South Carolina?

Passing a stopped school bus is worth 6 points on the South Carolina point schedule. Points drop by half one year after the violation date on the ticket.
For a new driver, one such conviction is enough for a suspension. A beginner's permit, conditional license or special restricted license holder with six or more points loses driving privileges for six months, and a defensive driving course does not end that suspension. South Carolina school bus law: common questions

Do I have to stop when a school bus has its amber lights on or its stop arm out?

Stop. The law bans passing a bus that has its amber signals on and requires a full stop for flashing red lights. The SCDMV Driver's Manual goes further: stop for the whole time a bus is stopped or preparing to stop with its red or amber lights flashing or its stop arm extended.

Do I have to stop for a school bus in a loading area off the road?

Usually not. The law tells the bus driver not to turn on the special signals in a school bus loading area when the bus is completely off the road. The SCDMV manual adds that you need not stop when the bus is in a loading zone fully off the main travel lanes and people may not cross the road there.

Does the South Carolina school bus law apply on a private road?

Yes. The stop rule covers a school bus stopped on a highway or on a private road. The multi-lane exception uses the same test on both: four or more traffic lanes, with at least two in each direction. On a smaller private road, stop from either direction when the red lights flash.

Can I get points for passing a school bus in another state?

Yes, it can count. The SCDMV says that a traffic conviction in South Carolina or in any other state is sent to the SCDMV and posted to your record. You may also get points on your South Carolina record for breaking the law in another state.
