Driving in West Virginia on a Foreign License: 90-Day Rule
Can you drive in West Virginia on a foreign license?
Yes, for a short time. A nonresident who is at least 16 and has a valid license from another state or country with them may drive in West Virginia as a noncommercial driver for not more than 90 days in one calendar year. If you take up residence, you must apply for a West Virginia license within 30 days.
Where these rules come from
West Virginia sets these rules in W. Va. Code 17B-2-2 (persons exempt from a license) and in W. Va. Code 17A-2-10b (foreign license agreements, new in 2026). The West Virginia DMV procedures page lists the same exemptions. The 30-day residency deadline is in W. Va. Code 17B-2-1a, and the document list comes from the DMV page for non-immigrants. This guide is current as of 2026. Confirm the rules with the West Virginia Division of Motor Vehicles (dmv.wv.gov) before you drive.
Which West Virginia rule fits your case?
| Your case | What the law says | Limit |
|---|---|---|
| Nonresident visitor, 16 or older, with a valid license from another state or country | Exempt from a West Virginia license if you have the license in your immediate possession (W. Va. Code 17B-2-2) | Noncommercial driving only, not more than 90 days in one calendar year |
| Nonresident who works or does business in West Virginia | A second exemption, in addition to the 90 days, for travel to and from work and for work duties that do not need a Class A, B, C or D license | Does not cover a person who must get a West Virginia license under the 30-day residency rule |
| Student at an accredited West Virginia school, college or university, 16 or older | The student exemption names a license from your home state, not a home country | Ends at once when you graduate, are expelled or stop being a student |
| Resident of West Virginia | You need a West Virginia license unless you are exempt | Apply within 30 days after you take up residence |
How the 90-day rule works
The limit counts days in any one calendar year. You must be at least 16, have a valid license from your home state or country in your immediate possession, and drive only as a noncommercial driver.
The permission does not apply if the Commissioner of the Division of Motor Vehicles decides that your home state or country does not give the same privileges to West Virginia residents. Carry the license every time you drive: you must show it on demand to a law enforcement officer, and a violation is a misdemeanor. The practice question on the license in your immediate possession tests that rule.
What international students need to know
The student exemption covers a student who is enrolled at an accredited school, college or university in the state, is at least 16 and holds a license issued in the student's home state. It holds only if the student's state of residence gives the same privileges to West Virginia residents.
Because the exemption names a home state, not a home country, a student from another country should plan on the general nonresident rule: 90 days in one calendar year. The student exemption ends at once when the student graduates, is expelled or stops being a student. If you stay and take up residence, the 30-day deadline applies.
The 2026 law on foreign license agreements
House Bill 4577 created section 17A-2-10b. The Governor approved it on April 1, 2026, and it took effect June 12, 2026. The law tells the Commissioner to seek reciprocal agreements with two countries: the Republic of Ireland and Japan.
The Commissioner may sign an agreement only after finding that the foreign license requirements are at least as stringent as those of West Virginia. Under an agreement, a citizen of that country who is lawfully present in the United States may drive on a valid license from that country without a West Virginia license, subject to the agreement terms. That driver must obey West Virginia compulsory insurance and financial responsibility laws.
What should you do?
Documents for a non-immigrant who applies for a West Virginia license
- A valid foreign passport with English translation, and a Social Security card.
- A Form I-94, and a U.S. visa if the applicant is from a nation whose citizens must get a U.S. visa.
- All original INS documents that show status and length of authorized stay.
- Two proofs of West Virginia residency. A document with a PO Box is not acceptable, and a residential rental or lease agreement is on the accepted list.
- F-1 or F-2: a Form I-20 and written proof of attendance at the school on the form, not more than 20 days old.
- J-1 or J-2: a Form DS-2019 and written proof of employment or attendance at the school on the form, not more than 30 days old.
- Work-related status: written proof from the employer, not more than 30 days old, for the applicant and for dependents.
When you need a West Virginia license
No person may drive on a West Virginia street or highway without a valid license for the vehicle, unless the law expressly exempts that person. If you live in West Virginia, you need a West Virginia license unless you are exempt. The practice question on the driver who must hold a West Virginia license shows how this rule works, and the one on the 30-day deadline for new residents covers the time limit. Foreign license in West Virginia: common questions
Do the 90 days start on the day I arrive in West Virginia?
No. The law limits nonresident driving to 90 days in any one calendar year, so the count runs from January to December. Days you drive in December count toward that year, and the days from January 1 count toward the new year.
Can I drive a truck or bus for work on a foreign license?
Not on a regular license. The 90-day permission is for noncommercial driving only. A nonresident who works or does business in West Virginia has a second exemption for travel to and from work and for work duties, but only if the work does not need a Class A, B, C or D license. A separate rule covers a nonresident who is 18 or older and has a valid commercial driver's license from the home state or country that meets the requirements of the federal commercial motor vehicle act of 1986.
Can an F-1 student drive on a home-country license for the whole study time?
Do not plan on it. The student exemption in the law covers a license issued in the student's home state, not a home country. Plan on the 90-day nonresident rule: not more than 90 days in one calendar year, as a noncommercial driver. The student exemption also ends when you graduate or stop being a student.
Is there a reciprocal agreement with Japan or Ireland now?
The 2026 law authorizes the Commissioner to make agreements with the Republic of Ireland and Japan, and the Commissioner must propose rules for legislative approval. Ask the DMV whether an agreement applies to you before you rely on one.
What happens when I take up residence in West Virginia?
Every driver must apply for a West Virginia license within 30 days after taking up residence. It is unlawful to hold more than one valid driver's license at any time. If you are a non-immigrant, bring the documents in the list above, including two proofs of West Virginia residency.
Do I need a Social Security number to get a West Virginia license on an F-1 visa?
The DMV list for non-immigrants includes a Social Security card. An applicant who is not eligible for a Social Security number must submit a denial letter from the Social Security Administration. An F-1 or F-2 applicant also brings a Form I-20 and written proof of attendance, not more than 20 days old.
