Foreign Driver's License in New York: Can You Drive and How to Switch

informational·how to guide·

Where the New York foreign license rules come from

The rules come from the New York State DMV pages Resources for Non-US Citizens and Driving in New York State. The steps and the road test details come from the DMV learner permit, pre-licensing course and road test pages, the New York State Driver's Manual (MV-21) and the DMV form ID-44. This guide is current as of 2026. Confirm the rules with the New York State DMV (dmv.ny.gov) before you drive.

Do you need a New York license? Three cases

You are a visitor
Drive with your valid foreign license. You do not need a New York license, and the rule is the same for a license from any country. You must be at least 16: under 16, you cannot drive in New York, even with a license from another place.
You study in New York
Students from other countries who attend school in New York are usually not considered New York residents, so your valid foreign license is normally enough.
You become a New York resident
You must get a New York license within 30 days. If your license is from outside the U.S. and Canada, follow the steps below.

Do you need an International Driving Permit in New York?

No. An IDP is not required, but it is helpful. It shows in several languages that your license is valid, so a police officer who cannot read the language on your foreign license can read the permit. You get an IDP from the authorities in your home country, so apply there before you travel.

When does a visitor become a New York resident?

New York law defines a resident as a person who lives in the state with the intention of making it a fixed and permanent home. If you keep a place to live in New York for at least 90 days, that is presumptive evidence that you are a resident. A police officer can use it as evidence for a ticket if you drive without a New York license or vehicle registration. A judge, not the DMV, decides if you are a resident. The judge looks at your intent, for example where you pay taxes and where your children go to school.

How to get a New York license when you are a resident

  1. 1
Apply for a new original license

If your license was issued outside the U.S. or Canada, you apply for a new original New York license at a DMV office. The first step is a learner permit. New York residents who are 16 or older can apply for one.

  2. 2
    Bring your proof documents

You need proofs of name that total 6 points or more. A foreign driver license with photo is one accepted proof if it is current or expired no longer than 2 years. A document in a foreign language needs a certified English translation.

  3. 3
Pass the vision test and the written test

The Driver's Manual says that a new resident with a license from outside the U.S. and Canada must pass the vision test and a written test. You can take the Class D permit test in English or in one of 19 other languages.

  4. 4
    Complete the 5-hour course

The pre-licensing course is called the 5-hour course. You finish it before the road test, unless you complete a 48-hour driver education program at a local high school or college. The guide to the 5-hour pre-licensing course has the details.

  5. 5
    Pass the road test

Take the road test after you have your learner permit and finish the course. All new license holders, whatever their age, then have a 6-month probationary period. The New York road test guide covers the test day.

What happens to your foreign license at the road test?

When you pass your road test, you must give your foreign license to the DMV road test examiner, and the local DMV office destroys it. The Driver's Manual adds one option: the license is destroyed unless you give the examiner a written request to hold it on file at a New York DMV office. If you make this request, the examiner tells you which DMV district office holds your license.

Can you drive alone on a New York permit with a foreign license?

Yes. If you hold a New York learner permit and a valid foreign license, your foreign license lets you drive without a supervising driver. You can drive on any street, road, highway, bridge or tunnel, except in a DMV road test area. Without a valid foreign license, a supervising driver who is 21 or older and holds a valid license for the vehicle must ride with you. The practice question on who may supervise a learner permit holder tests this rule.

What to bring to the road test with a foreign license

  • An International Driving Permit or a certified translation of your license, if your license is printed in any language except English.
  • Your physical photo learner permit.
  • Your original pre-licensing course certificate (MV-278). Copies are not accepted.
  • A vehicle with valid registration, insurance and inspection that operates properly and is in clean condition.
  • The driver who comes with you. No other passengers are allowed in the vehicle.

What a certified translation of your license must show

  • Certification by a consulate, the U.S. Department of State or another official government agency.
  • Your name and your date of birth.
  • The expiration date of your foreign license.
  • The types of vehicles that your foreign license allows you to drive.
