Oklahoma Texting While Driving Law and 2025 School Zone Phone Ban

informational·how to guide·

Where the Oklahoma phone law facts come from

The texting ban comes from 47 O.S. § 11-901d and the school zone and work zone rule from 47 O.S. § 11-901e (House Bill 2263), both in the Oklahoma Statutes. The full time and attention rule comes from 47 O.S. § 11-901b, and the permit, intermediate license and Farm Driving Permit rules from 47 O.S. § 6-105 and the Service Oklahoma Farm Driving Permit page. Safety tips come from the Oklahoma Driver Manual. This guide is current as of 2026. Confirm the rules with Service Oklahoma (oklahoma.gov/service) before you drive.

What does the Oklahoma texting law ban?

On any Oklahoma street or highway, you may not use a hand-held device to type, send or read a text message while your vehicle is in motion. Texting while driving has been illegal in Oklahoma since 2015. The fine under 47 O.S. § 11-901d is up to $100, and no points go on your driving record. Our free question on texting while the vehicle moves tests the same rule.

What is the 2025 school zone and work zone rule?

A newer law, 47 O.S. § 11-901e, took effect November 1, 2025. It covers two places:
- A properly marked school zone, with warning signs placed under the Manual on Uniform Traffic Control Devices, while its posted reduced speed limit is in effect because school children are or may be present.
- A road construction zone.
In these places, while the vehicle is in motion, you may not hold or use a hand-held cell phone. You also may not use a hand-held device to type, send or read a text. The fine is up to $100, and no points go on your driving record.

Can I use my phone in a school zone or work zone?

You use a hands-free or voice-operated system
The rule does not apply. Hands-free or voice-operated technology is allowed in school zones and road construction zones. Whenever possible, still pull off the road before you make a call.
You hold the phone in your hand
This is a violation in a marked school zone with its reduced limit in effect, and in a road construction zone, while the vehicle moves. Try our free question on a phone call in a school zone.
You call about an imminent emergency
The rule does not apply when your sole purpose is to contact emergency services, a hospital, a doctor's office or clinic, an ambulance provider, firefighters or police about an imminent emergency.

What the Oklahoma phone laws do not cover

  • A hands-free device that lets you write, send or read a text without either hand, except to start, stop or begin a feature.
  • A device built into the vehicle, and a voice-operated GPS or navigation system fixed to the vehicle.
  • An ignition interlock device installed in the vehicle.
  • A phone you use only to contact emergency services, a hospital, a doctor's office or clinic, an ambulance provider, firefighters or police about an imminent emergency.
  • In school zones and road construction zones, amateur radio is also outside the rule.

Can police take or search my phone in a school or work zone?

For a school zone or road construction zone phone violation, an officer may not take your phone without your consent to check that you obey the rule, or keep it as evidence for the trial. The officer also may not download data from your phone for that violation without your consent, unless the officer has probable cause that the phone was used in a crime, has a valid search warrant, or another law allows it.

What if you drive with a permit or an intermediate license?

Service Oklahoma may, at its discretion, suspend or cancel a learner permit or an intermediate license for hand-held device use while you drive for a non-life-threatening emergency purpose. "Using" a device means engaging any function on it. A 911 call about a crash with injured people is a life-threatening emergency, so this reason does not apply to it: see our free question on a teen driver's phone use. For the other limits, read our guide to the Oklahoma intermediate license.
A Farm Driving Permit holder may not operate a wireless communication device while driving, except to report illegal activity or call for medical or other emergency help.

Can you get a ticket for distracted driving without texting?

Yes, in some cases. Every Oklahoma driver must give full time and attention to driving (47 O.S. § 11-901b). An officer may cite you under that law only after seeing you in a crash, or seeing you drive in a way that is an articulable danger to other people on the road that no other law covers. Distraction comes in three kinds: visual (eyes off the road), manual (hands off the wheel) and cognitive (mind off driving).

Oklahoma phone laws: common questions

Is it legal to talk on a hand-held phone while driving in Oklahoma?

For an adult with a regular Class D license, state law bans holding a phone only in a marked school zone while its reduced limit is in effect and in a road construction zone. Texting by hand is banned on every street and highway. A learner permit or intermediate license holder can lose the license for hand-held use that is not for a life-threatening emergency.

Can an Oklahoma city fine me more than $100 for texting while driving?

No. Cities and towns may enforce their own texting and phone ordinances, but the rules must match state law and the enforcement may not be stricter. For texting, the city fine and court costs must be the same as or less than the state fine of up to $100. For school zones and road construction zones, the total fine and court costs may not go above $100.

Does the school zone phone rule apply all day?

No. In a properly marked school zone, the hand-held rule applies only while the posted reduced speed limit is in effect, at the times set because school children are or may be present. In a road construction zone, it applies while your vehicle is in motion. The texting ban applies on every street and highway at all times.

Are photos and email included in the Oklahoma texting ban?

Yes. The law defines a text message as a text-based message, instant message, electronic message, photo, video or email. The ban covers manual entry, sending or retrieval of any of these on a hand-held device while the vehicle moves. Voice-operated and hands-free systems are outside the ban.

Do commercial and transit drivers have extra phone rules?

Yes. The Oklahoma Driver Manual says commercial drivers and public transit drivers may not make hand-held phone calls while driving. The texting ban and the school zone and work zone rule also apply to them. If you drive a commercial vehicle, ask Service Oklahoma which rules apply to your license class.
