Pennsylvania Junior License Rules: 11 p.m. Curfew and Passenger Limits
What are the Pennsylvania junior license rules?
A junior license holder (16 or 17) may not drive 11 p.m. to 5 a.m. unless a parent, a spouse 18 or older or a person in loco parentis rides along. Trips for a job, a volunteer fire company or public or charitable service are exceptions. For six months, you may carry one passenger under 18 who is not immediate family, then three. Passengers may never outnumber seat belts.
Where the Pennsylvania junior license rules come from
The rules come from Pennsylvania Vehicle Code section 1503 (junior driver's license), section 4581 (seat belts for drivers under 18) and the PennDOT Pennsylvania Driver's Manual. Section 1505 (learner's permit) and the PennDOT parent guide PUB 385A also helped. This guide covers Pennsylvania only and is current as of 2026. Confirm the rules with PennDOT Driver and Vehicle Services (pa.gov/dmv) before you drive.
When can I drive alone in Pennsylvania?
Not on a learner's permit. A permit holder always drives with a supervisor in the seat beside them: a licensed driver 21 or older, or a licensed spouse, parent, guardian or person in loco parentis 18 or older. Before the road test for a junior license, a person under 18 must hold the permit for six months and have a signed certification of 65 hours, with at least 10 hours at night and 5 in bad weather. The 65-hour driving log guide shows how to track them.
With a junior license you may drive alone. The curfew and passenger limits below are junior license rules, not permit rules.

What is the junior license curfew?
A junior driver may not drive on a public road between 11 p.m. and 5 a.m. unless a spouse who is 18 or older, a parent or a person in loco parentis is in the car. The PennDOT manual also names a guardian.
What are the curfew exceptions?
You may drive between 11 p.m. and 5 a.m. if you have a job, are a volunteer firefighter, or do public or charitable service. The trip must be between home and the activity or job, or part of it. Carry an affidavit or certificate of authorization, signed by your fire chief, supervisor or employer, that shows your probable schedule. The manual says the affidavit is notarized and should be kept with your license. When the job or activity ends, return it to the person who signed.
A trip home from a friend's house is not an exception. See the question about a 16-year-old who drives home alone at 11:30 p.m..
How many passengers can a junior driver carry?
Who counts as immediate family?
Your brothers, sisters, stepbrothers and stepsisters count as immediate family, including adopted or foster children who live in your household. They do not count toward the limit. For example, if your junior license is three months old, you have no crashes or tickets and no parent rides along, you may drive only one of two friends who are 16 and not family.
What are the seat belt rules for a junior driver?
- Wear a fastened seat belt each time you drive.
- Make sure that every passenger aged 8 to 17 wears a belt.
- Do not carry more passengers than seat belts. The law sets this count rule "notwithstanding" the junior passenger limit, so it applies even with a parent in the car.
- These rules apply to every driver under 18: on a learner's permit, a junior license or a regular license.
- A violation of the belt rule or the passenger-count rule is a summary offense with a fine of $10 (U.S. dollars). It is not a moving violation, and the belt violation carries no points.
What happens if you break a junior license rule?
A junior driver or any other person who breaks a junior license rule is guilty of a summary offense. PennDOT may also suspend a junior driver after a reportable crash that was partly or fully the driver's fault, or after any conviction for a Vehicle Code violation. The suspension can last until age 18 or for up to 90 days. To find out how to leave the junior license rules before 18, read the guide to the junior to senior license change.
Frequently Asked Questions
Can a junior driver drive to work after 11 p.m.?
Yes, if the job is the reason for the trip. You may drive between home and work, or during work, with an affidavit or certificate of authorization from your employer that shows your probable schedule. Keep it with your license, and give it back when the job ends.
Can I carry more friends if my parent is in the car?
Yes, for the limit on passengers under 18 who are not family. A parent or legal guardian in the car lifts that limit. You still cannot have more passengers than seat belts.
Do my brothers and sisters count toward the passenger limit?
No. Brothers, sisters, stepbrothers and stepsisters are immediate family, including adopted or foster children who live in your household. Only passengers under 18 who are not family count toward the limit. You still cannot carry more passengers than seat belts.
Does a friend who is 18 count toward the passenger limit?
No. The junior passenger limit counts only passengers under 18 who are not immediate family. A friend who is 18 or older does not count toward it, in the first six months or after. The seat belt rule still applies: you cannot carry more passengers than seat belts.
Is there a fine for too many passengers on a junior license?
More passengers than seat belts is a summary offense with a fine of $10 (U.S. dollars), and it is not a moving violation. Too many friends under 18 who are not family breaks the junior passenger limit, which is also a summary offense. After a conviction, you stay at one passenger, and PennDOT may suspend your junior license.
Can I drive after 11 p.m. if a friend who is 21 is in the car?
No. During the 11 p.m. to 5 a.m. curfew, only a spouse who is 18 or older, a parent or a person in loco parentis lets you drive. The PennDOT manual adds a guardian. An older friend does not, unless the trip is for your job, a volunteer fire company or public or charitable service.
