Utah Provisional License Rules: Midnight Curfew and Passengers

informational·how to guide·

Where the Utah teen driving limits come from

The night limit is in Utah Code 41-8-2, and the passenger limit is in Utah Code 41-8-3. The Driver License Division (DLD) lists both limits on its teen driver restrictions page. The license steps and the card, phone, alcohol and point rules come from Utah Code 41-8-4, 53-3-204, 53-3-205, 53-3-207, 53-3-211 and 53-3-231, the Utah Driver Handbook 2026 and the DLD license, exam and points pages. This guide is current as of 2026. Where a DLD page and the law text differ, this guide follows the law. Confirm the rules with the Utah Driver License Division (dld.utah.gov) before you drive.

Steps to a Utah provisional license at 16

  1. 1
    Be at least 16

Utah does not license a person younger than 16.

  2. 2
    Finish driver education

A driver education course is required if you are 18 or younger. You also need 40 hours of driving with a parent or legal guardian, and 10 of those hours must be after sunset. The Utah driver education requirements explain the course choices.

  3. 3
Hold a learner permit for six months

If you are 17 or younger, you must hold a learner permit for six months before you apply.

  4. 4
Pass the Traffic Safety and Trends Exam

All first-time drivers take this online exam, and it needs 100% to pass.

  5. 5
    Pass the driving skills test

You must pass the driving skills test before you are licensed for the first time. Your license application and fee give you up to three attempts to pass the knowledge and skills tests within six months after the application date.

  6. 6
Apply with a parent or guardian

A parent or guardian signs your application, and signs for financial responsibility if you are under 18. The original license fee for a minor is $39, and it is not refundable.

What does provisional mean on a Utah license?

A provisional license is the Class D license that Utah issues to a driver younger than 21. It is a regular Class D license, with a separate point system for drivers under 21. The card has a portrait layout and prints the date you turn 21. An original provisional license expires on your birthday in the fifth year after the year it is issued. The night and passenger limits below are part of the DLD's Graduated Driver License (GDL) program.

Utah midnight curfew: who it covers and when it ends

The law bans driving on any Utah highway from 12:00 a.m. to 5:00 a.m. for a person younger than 17. The limit ends on your 17th birthday, so it does not apply to a 17-year-old. To check that you know the rule, try the question about a 16-year-old who drives home after midnight.

Exceptions to the Utah night limit

  • A licensed driver at least 21 years old sits in the seat next to you.
  • You drive for your job, including the trip between home and work.
  • You drive straight home from a school-sponsored activity, but only when a school or school district provided the transportation and it started and ended at your school.
  • You work on assignment from a farmer or rancher in an agricultural operation.
  • You drive in an emergency.

Utah passenger limit: can a 16-year-old drive friends?

No, not at first. You may not carry a passenger who is not an immediate family member until the earlier of two dates: six months after your license was issued, or your 18th birthday. Three exceptions apply: a licensed driver 21 or older sits next to you, you do farm or ranch work on assignment, or you drive in an emergency. For either limit, a violation is an infraction, and an officer may not impound your car for that citation alone. See the question about a 16-year-old who wants to drive two classmates.

When do the limits end for you?

You get your license at 16 years and 2 months
The passenger limit ends at 16 years and 8 months. The night limit ends on your 17th birthday, 10 months after you are licensed.
You get your license at 16 years and 9 months
The night limit ends on your 17th birthday, 3 months after you are licensed. The passenger limit ends at 17 years and 3 months.
You get your license at 17 years and 8 months
The night limit does not apply, because you are already 17. The passenger limit ends on your 18th birthday, 4 months after you are licensed, because that comes before six months.

Other limits for young Utah drivers

  • Phone: a driver younger than 18 may not use a wireless phone to communicate with another person while driving. A call to a parent or legal guardian, or a call in a medical emergency or to report a safety hazard or a crime, is a legal defense. The fine is a maximum of $25, and no points apply.
  • Alcohol: a driver younger than 21 may not drive with any measurable alcohol. The Driver Handbook says a first offense denies all driving privileges for six months.
  • Points: a driver younger than 21 with 70 or more points in three years is called to a hearing and can be suspended or denied for 30 days to a year. The guide to Utah teen driver penalties covers what happens next.

Key takeaways

  • You can get a Utah provisional license at 16. Until your 17th birthday, you may not drive from 12:00 a.m. to 5:00 a.m.
  • No passengers who are not immediate family until six months after license issue or age 18, whichever comes first.
  • A licensed driver 21 or older beside you is an exception to both limits.
  • A provisional license is the Class D license for drivers under 21. It expires on your birthday in the fifth year after issue.

Utah provisional license: common questions

Can I drive to a late job at 16 in Utah?

Yes. Driving for your job is an exception to the 12:00 a.m. to 5:00 a.m. limit, and it includes the trip between your home and your work. The law treats it as a defense to a night-limit charge.

Can I drive my friends if I get my license at 18?

Yes. The passenger limit ends at age 18, and the night limit ends at 17, so neither limit applies to a new driver who is 18 or older. Your license is still provisional until 21, so the under-21 point system and the no-alcohol rule apply.

Can I be pulled over only for carrying friends?

No. Utah law lets officers enforce the passenger limit only as a secondary action. An officer must first detain you for another suspected motor vehicle violation or another offense. Then the officer can also cite you for the passenger limit.

How long does a Utah provisional license last?

An original provisional license expires on your birthday in the fifth year after the year of issue. For example, a license issued in 2026 expires on your birthday in 2031. The card also shows the date you turn 21.

Do the Utah limits apply to teens visiting from another state?

Yes. Both laws apply to residents and nonresidents. A visiting driver younger than 17 may not drive from 12:00 a.m. to 5:00 a.m. A visiting new driver younger than 18 may not carry non-family passengers for six months after the license was issued.
