Can International Students Drive in New York on a Home License?

informational·how to guide·

Where these rules come from

These rules come from the New York State DMV pages Driving in New York State, Resources For Non-US Citizens and Enhanced or REAL ID, the DMV pages Get Your Learner Permit and Driver License and Moving to or from New York State, and the DMV form ID-44 (How to Apply), as of 2026. Confirm the rules with the New York State DMV (dmv.ny.gov) before you drive.

When a student becomes a New York resident

Students from other states or countries who attend school in New York are usually not residents, and the guide to a foreign driver's license in New York explains how the law defines a resident and who decides.

Which rule applies to you

You have no driver license from your home country
To drive in New York, you must be at least 16 and hold a valid learner permit or license from New York or from another state or country. The steps below show how to get a New York license.
You become a New York resident
You must get a New York license within 30 days. If your license was issued outside the U.S. or Canada, you apply for a new original New York license at a DMV office.
You hold a New York learner permit and a valid foreign license
Your foreign license lets you drive without a supervising driver on any street, road, highway, bridge or tunnel, except in a DMV road test area.
You hold a New York learner permit and no valid foreign license
A supervising driver must ride with you. That driver must be 21 or older and have a valid license for the vehicle you drive. Test yourself on who may supervise a learner.
You are under 18
You must obey New York's Graduated License Law.

How to get a New York license as a new resident

  1. 1
    Check that you can apply

New York residents 16 and older can apply for a learner permit, the first step to a license. You do not need to be a U.S. citizen to get a New York license, permit or non-driver ID card.

  2. 2
    Gather your documents

Complete the MV-44 application. Bring proofs of name worth at least 6 points and proof of your New York address: 1 proof for a Standard license or permit, 2 for a REAL ID. If you have temporary lawful status, bring current DHS documents. For a REAL ID, a foreign passport counts as proof of lawful status with a valid visa and an I-94 or a Customs and Border Patrol stamp. The ID-44 form also accepts a foreign passport with a valid I-551 stamp. The guide to New York DMV documents and 6 points of ID lists what counts.

  3. 3
Pass the written test and a vision test

You must pass both to get a learner permit.

  4. 4
Practice and take the 5-hour course

Before the road test, practice driving with a licensed driver and complete the 5-hour pre-licensing course at a registered provider.

  5. 5
    Pass the road test

The road test is the last step to a New York license. If your license was issued outside the U.S. or Canada, you must give it to the DMV road test examiner when you pass, and the local DMV office destroys it.

What a REAL ID shows for a Temporary Visitor

A REAL ID is optional, and you do not need one to be licensed to drive. If you get one, the DMV counts you as a Temporary Visitor when you are not immigrating to or permanently living in the United States and your Department of Homeland Security (DHS) documents support your legal status. Your REAL ID license, permit or non-driver ID card then shows "TEMPORARY VISITOR" and your DHS document expiration date. For a REAL ID, the DMV prints only your legal name, and your 2 proofs of address cannot show a P.O. Box.

Renewing when your Temporary Visitor status changes

  1. 1

Your status on file is current

While the Temporary Visitor status that the DMV has on file has not expired, you can renew your license online, by mail or in a DMV office.

  2. 2

    Your status is extended

Go to a DMV office with a completed MV-44 application, your updated DHS paperwork and 6 points of identification. The DHS documents must be valid, current and verifiable.

  3. 3

    The DMV updates its records

The DMV records the extension so that you can renew. Your new license shows your new Temporary Visitor expiration date.

Key takeaways

  • A valid license from any country lets you drive in New York. You need a New York license only if you become a resident.
  • Students from other countries are normally not New York residents.
  • A new resident must get a New York license within 30 days: written and vision tests, the 5-hour course, then the road test.
  • A REAL ID for a Temporary Visitor shows "TEMPORARY VISITOR" and the DHS document date. If your status is extended, bring updated DHS paperwork to a DMV office.
  • Next step: practice the rules of the road on the free New York Class D permit practice test.

International students driving in New York: common questions

Do I need a REAL ID to drive in New York as a student?

No. A REAL ID is optional, and you do not need one to be licensed to drive. Non-citizens can get a Standard license, and non-citizens who can show proof of lawful presence can get a REAL ID. There is no extra fee for a REAL ID, but the normal transaction fees apply.

Can I use a P.O. Box address for a REAL ID?

No. For a REAL ID, the DMV does not accept a proof of residency that shows a P.O. Box. You need 2 proofs of your New York address for a REAL ID, and 1 proof for a Standard license or permit.

Can I fly within the U.S. with a New York license?

Only with a REAL ID or an Enhanced license. A Standard license says "NOT FOR FEDERAL PURPOSES" on the front and is not accepted to board a domestic flight. A valid passport also lets you board, so an international student with a Standard license can fly on a passport.

Does my New York license expire when my visa status ends?

Plan for the stricter rule, because two DMV texts differ. The DMV form ID-44 says a new REAL ID learner permit for a person with temporary lawful status expires no later than the status document. The DMV page for non-US citizens says your DMV document does not expire on the Temporary Visitor date on your card. Ask the New York State DMV before your status document expires.
